Tuesday 4th of February 2020 - Borough Council Meeting

            Pen Argyl Borough Council held their Regular Council Meeting on Tuesday,

February 4, 2020 at 7:00 P. M. in Council Chambers.

 

Pledge of Allegiance:                                                 

            Council President Joseph LeDonne was acting Mayor and Council Vice President Roberta Cowley was acting Council President.   Council Vice President Roberta Cowley opened the Council Meeting with the Pledge of Allegiance.

 

Roll Call:

 

The following Council Members were present and responded to roll call: Joseph LeDonne, Tammy Kemp, Scott Brumbaugh, Janell Connolly, Roberta Cowley, John Apgar and Josephine Hildabrant.  Council Member Charles Kandl Jr. was absent.

Also present were Borough Manager Robin Zmoda, Borough Solicitor Peter Layman and Administrative Assistant Juli Lemak.  Mayor Stephen Male was absent.  

Visitors:                                  

            Members of the Blue Mountain Community Library gave their annual 2019 report.

            Keith Miller, representative of the Mission of Love Food Bank Ministry, requested use of the Borough hall kitchen one (1) day a week to prepare food and feed people in need within the Slate Belt.  No action was taken on this matter.

 

Public Works Report:             

            All Council Members were given a copy of Public Works Director Steven Bender's January report to review. 

 

Council was given the MS4 Stormwater BMP from Barry Isett & Associates.  A meeting is to be scheduled with engineers, Green and White Association, Property Committee and adjacent businesses to discuss a plan for the trailhead, planning and budgeting.

Zoning Report: 

 

            All Council Members were given a copy of Zoning/Codes Office's January report.

 

Police Report: 

 

All Council Members were given a copy of the Slate Belt Regional Police Meeting minutes from January 7, 2020 and agenda from January 16, 2020.

 

Council was given a copy of the draft amendment to the charter agreement for review.

 

 

Fire Chief's Report: 

 

            Fire Chief Parsons reported the fire company received thirteen (13) calls for the month of January.  The total hours spent on drills was 218 and 212 hours on calls for a total of 430 man hours. 

 

Council Members and Dean Parsons were given a copy of the Promissory Note for review.    

 

Minutes:

Councilwoman Tammy Kemp made a motion to approve the Minutes for the Council Meeting of Monday, January 6, 2020, with the correction of changing the Re-Organization of Council Vice President vote to “Mayor Male called for the vote” and changing the Re-Organization of President Pro-Tem vote to “Mayor Male called for the vote,seconded by Councilwoman Josephine Hildabrant.  The motion passed unanimous by roll call.

Councilwoman Josephine Hildabrant made a motion to appoint Robert O’Donnell to the Park Board, seconded by Councilwoman Janell Connolly.  The motion passed unanimous by roll call.

Council was given the agenda and information materials from the Park Board Meeting of January 14, 2020 and meeting minutes from November 19, 2019. 

Council received the Slate Belt Council of Governments (COG) Meeting minutes from January 22, 2020.

Correspondence:                   

            Slate Belt Heritage Center, thank you for the donation.

            Fulton Bank, the branch located at 1309 Blue Valley Drive, Pen Argyl will be closing on April 24, 2020.

 

            A check in the amount of $41.00 from Prints Galore for sale of park merchandise was received.

 

Mayor's Report:

                       

            Acting Mayor LeDonne presented the Waste Management 2019 annual report for Council’s review.   

 

Planning Commission:

            The Plan Slate Belt Meeting will be held on February 5, 2020.


Solicitor's Report:

Solicitor Layman provided Council with correspondence from Eckert Seamans Cherin & Mellott, LLC, requesting the Borough consider adopting a Slot Machine Nuisance Ordinance.  No action was taken on this matter. 

 

            Solicitor Layman provided a memo regarding rental or lease of Borough property.

 

            All Council Members were given a copy of correspondence from Synagro.  Synagro is no longer pursuing development of the Slate Belt Heat Recovery Center Project that was proposed for an area of land on the Grand Central Landfill property. 

 

Sanitation, Solid Waste & Recycling:

            All Council Members were given a copy of the Wastewater Treatment Plant January report, Committee report from February 3, 2020 and Authority minutes from August 27, 2019. 

 

Council received a memo regarding grease traps or grease interceptors from Borough Solicitor Layman. 

 

Councilwoman Janell Conolly made a motion to advertise for sludge removal bids, seconded by Councilman Scott Brumbaugh.  The motion passed unanimous by roll call.

Finance, Tax Exoneration, Insurance & Personnel:

            Council received notification from the Pen Argyl School District that the Board of Directors passed a resolution to eliminate the District Per Capita Taxes effective July 1, 2020. 

 

All Council Members were given a copy of the January Treasury Report as prepared and submitted by Borough Manager/Treasurer Zmoda.  Councilwoman Tammy Kemp made a motion to accept the Treasury Report as prepared, seconded by Councilwoman Josephine Hildabrant.  The motion passed unanimous by roll call.

 

Councilwoman Tammy Kemp made a motion to approve the 2019 Per Capita Tax Exonerations Report as submitted by Tax Collector Michael Zavacky, seconded by Councilman Scott Brumbaugh.  The motion passed unanimous by roll call.

Council reviewed the list of delinquent 2019 Per Capita Taxes as submitted by Tax Collector Michael Zavacky.  Councilman Scott Brumbaugh made a motion to turn the list of 2019 delinquent Per Capita Taxes over to Berkheimer for collection, seconded by Councilwoman Josephine Hildabrant.  Unanimous vote by roll call.

 


Finance, Tax Exoneration, Insurance & Personnel con’t:

A list of the delinquent 2019 Borough Real Estate Taxes was also submitted by Tax Collector Michael Zavacky.  Councilwoman Josephine Hildabrant made a motion to turn the list of delinquent 2019 Borough Real Estate Taxes over to the County for collection, seconded by Councilwoman Tammy Kemp.  Unanimous vote by roll call.

Borough Manager Zmoda informed Council that she will review the Borough insurance coverage policies and contact multiple vendors for proposals. 

Property & Utilities:

            Nothing to report.

Community Outreach:

Councilwoman Josephine Hildabrant provided the Centennial Celebration draft of events to Council.

 

Councilwoman Tammy Kemp made a motion to cancel Founders Day this year, seconded by Councilwoman Janell Connolly.  Unanimous vote by roll call.

The Slate Belt Rising Steering Committee Meeting agenda from January 9, 2020, minutes from November 14, 2019 and December monthly report were received by Council.   

Borough Administrative Assistant Juli Lemak provided Council with the January feral cat report.

Council received the Pen Argyl Revitalization Plan Meeting agenda from

January 30, 2020.

 

Borough Manager's Report:

 

            Council Members reviewed correspondence from Lafayette College regarding their Municipal Government Student Internship Program. 

 

            Council requested Borough Manager Zmoda to instruct the zoning officer to drive through the Borough during the months of June through September for no more than one (1) hour per week, not to exceed a twenty (20) hour work week, to cite any zoning violations or unpermitted work being performed. 

 

            The Northampton County Emergency Management is sponsoring an Incident Command System/National Incident Management System class for elected officials on March 24, 2020. 

 

The Northampton County Council of Government’s agenda from January 22, 2020 was received.  The 2nd Annual Northampton County Festival will be held on May 23, 2020. 


 

Borough Manager Zmoda provided Council with correspondence from Monroe County LSA Program, the Borough was not awarded the grant for the ADA upgrade to the Borough hall. 

 

Council Members were given a copy of Borough Manager Zmoda’s January report.

 

Borough Manager Zmoda will conduct a boot camp for all Council Members on

March 21, 2020. 

 

Payment of Bills:

           

            The following bills were presented for payment:  General Fund, $20,129.41; Sewer

Fund, $50,535.94; State Fund, $3,606.64 and Reserve Money Market Fund, $14,508.92.  Councilman Scott Brumbaugh made a motion to pay the bills as presented, seconded by Councilman John Apgar.  The motion passed unanimous by roll call.

Executive Session: 

            Councilwoman Josephine Hildabrant made a motion to go into Executive Session to discuss potential litigation and personnel issues, seconded by Councilwoman Tammy Kemp.  Unanimous vote by roll call.

 

            Council went into Executive Session at 8:19 P.M. and reconvened at 8:49 P.M.

 

Special Note:  Borough Administrative Assistant Juli Lemak left the meeting at 8:19 P.M. and the rest of the minutes were taken by Borough Manager Zmoda.   

 

Adjournment

Councilwoman Josephine Hildabrant made a motion to adjourn, seconded by Councilman John Apgar.  Unanimous by voice vote.  Council meeting adjourned at 8:52 P.M.
