Tuesday 26th of November 2019 - Special Borough Council Meeting

            Pen Argyl Borough Council held a Special Council Meeting on Tuesday, November 26, 2019

at 7:00 P. M. in the Council Chambers for the purpose of adopting a Tentative 2020 Budget and for

General Purposes.

 

Pledge of Allegiance:

            Council President Joseph LeDonne opened the Council Meeting with the Pledge of Allegiance.

 

Roll Call:         

            Council Members present and responding to roll call were: Joseph LeDonne, Tammy

Kemp, Scott Brumbaugh, Janell Connolly, Roberta Cowley, Josephine Hildabrant and Robert O'Donnell.  Councilman Charles Kandl Jr. was absent. 

 

            Also present were Mayor Michael Nasatka, Borough Solicitor Peter Layman and Borough Manager Robin Zmoda.

 

Visitors:

            None

Discussion and Tentative Adoption of Year 2020 Budget:    

General Fund - $1,904,252.00 - 13.00 Mills (I mill increase)

Sewer Fund - $1,889,370.00

Garbage Fund - $459,210.00

State Fund - $246,304.00

Reserve Fund - $3,313,913.00

 

Tax Structure

Real Estate Tax Millage - 13.00 Mills

Per Capita - $ 5.00

Local Services Tax (LST) - $52.00

Real Estate Transfer Tax - 1% - Shared Equally with School District

Earned Income Tax - 1% - Shared Equally with School District

Sewer Rental Fee - $99.00 Minimum Quarterly Charge per Unit/10,000 Gallons

(increase of $3.00 Per Quarter) $13.50 per Thousand Gallon over 10,000 Gallons

Garbage Fee - Garbage Fee Waived for year 2020

 

            The Borough's Assessment Valuation for 2020 is $67,029,500; 2019 was $67,113,200; 2018 was $67,092,500; 2017 was $67,572,400 and 2016 was $67,524,800.  One (1) Mill equals $67,110.80, less 6% uncollectible, collectible amount is $63,084.15.

 

Prior years Millage was 9.75 Mills from year 2011 to and including year 2015.  Year

2016 Millage was 10.25 Mills and years 2017 and 2018 Millage was 11.00 Mills; year 2019 was 12 Mills. 

 


 

Discussion and Tentative Adoption of Year 2020 Budget con't:                   

            Council was given three (3) Tentative Year 2020 Budgets to review and discuss: a 12.50 mill budget which would draw $35,507.00 from Reserve Fund; a 12.75 mill budget which would draw $19,736.00 from Reserve Fund and a 1.0 mill budget which would draw $3,965.00 from Reserve Fund.

 

            Councilman Robert O'Donnell made a motion to adopt the Tentative Year 2020 Budget with a 1 mill increase, seconded by Councilwoman Tammy Kemp.  Voting in favor of the motion were Council members Joseph LeDonne, Tammy Kemp, Scott Brumbaugh, Janell Connolly and Roberta Cowley, voting against were Council members Robert O’Donnell and Josephine Hildabrant.  There being five (5) yes votes and two (2) no votes, the motion carried.

 

            Councilwoman Tammy Kemp made a motion to adopt the Tax Structure for year 2020 with a 13 mill Real Estate Tax, seconded by Councilman Scott Brumbaugh.  Voting in favor of the motion were Council members Joseph LeDonne, Tammy Kemp, Scott Brumbaugh, Janell Connolly, Roberta Cowley and Robert

O’ Donnell, voting against was Councilwoman Josephine Hildabrant.  There being six (6) yes votes and one (1) no vote, the motion carried.

 

Millage Ordinance and to suspend Residential Garbage Charges:   

            Councilwoman Janell Connolly made a motion to authorize Borough Solicitor Layman

to prepare and advertise the necessary ordinances for the 13.00 Tax Millage and to suspend residential garbage charges under Section 60-4D for the calendar year of 2020 for adoption at the Council Meeting of Tuesday, December 10, 2019, seconded by Councilman Robert O’Donnell.  Unanimous by roll call vote. 

 

Buy back of two (2) weeks unused vacation:

            Councilwoman Janell Connolly made a motion to buy back two (2) unused weeks vacation for management employees, seconded by Councilman Robert O’Donnell.  Unanimous vote by roll call. 

 

Minutes:        

            Councilman Robert O'Donnell made a motion to approve the Minutes for the Regular Council Meeting of Tuesday, November 5, 2019, seconded by Councilwoman Tammy Kemp.  Unanimous by roll call vote.

           

Police:

Councilwoman Roberta Cowley made a motion to authorize Borough Solicitor Layman to advertise and prepare an ordinance amending Article V, Section B of the Slate Belt Regional Police Department Charter Agreement with regard to the cost sharing formula; amending the definition of “incident” to provide that it should be determined by using the actual weighted incident data as compiled by the Chief of The Slate Belt Regional Police Department and utilizing The Nationally Accepted International Association of Chiefs of Police weighted calls for service scale; severability; repealer and effective date, for adoption at the Council Meeting of Tuesday, December 10, 2019 seconded by Councilwoman Tammy Kemp.  Unanimous vote by roll call. 

 

 

Sanitation, Solid Waste & Recycling:

 

            Council members were given copies of a draft ordinance to amend section 87-76 of the Pen Argyl Borough Code to increase the quarterly sewer rental fees charged by the Borough of Pen Argyl for Sewer Service from $96.00 a quarter per 10,000 gallons to $99.00 per 10,000 gallons. Councilman Robert O’Donnell made a motion to direct Solicitor Layman to advertise the ordinance for adoption at the Council Meeting of Tuesday, December 10, 2019, seconded by Councilman Scott Brumbaugh.  Unanimous vote by roll call. 

 

Councilman Robert O’Donnell made a motion to accept Premier Magnesia’s proposal to provide magnesium hydroxide to the wastewater treatment plant at the cost of $2.74/gallon, seconded by Councilman Scott Brumbaugh.  Unanimous vote by roll call. 

 

Manager:

 

Manager Zmoda stated the Borough has been awarded $20,000.00 from Northampton County’s CIPP program for the survey, GIS mapping and report of stormwater infrastructure.  The original request was for $37,000.00 and Council would need to approve an amended Sources and Uses Budget to reflect the difference if Borough would like to continue with the project and would contribute an additional $17,000.00 to complete the project.  Councilwoman Tammy Kemp made a motion to approve the amended budget, seconded by Councilwoman Janell Connolly.  Unanimous vote by roll call. 

 

Manager Zmoda noted the Borough Office will be closed Thursday, November 28th and Friday, November 29th for the Thanksgiving Holiday.

            Councilwoman Tammy Kemp made a motion to adjourn, seconded by Councilwoman Janell Connolly.  Unanimous by voice vote.  Council Meeting adjourned at 8:21 P.M.
