Tuesday 5th of November 2019 - Borough Council Meeting

Pen Argyl Borough Council held their Meeting for November on Tuesday, November 5, 2019

at 7:00 P.M. in the Council Chambers.

 

Pledge of Allegiance:

Council President Joseph LeDonne opened the Council Meeting with the Pledge of Allegiance.

Roll Call:

The following Council Members were present and responded to roll call: Joseph LeDonne, Tammy Kemp, Josephine Hildabrant, Robert O’Donnell, Roberta Cowley, Scott Brumbaugh, Charles Kandl Jr. and Janell Connolly.

Also present were Borough Manager Robin Zmoda, Borough Solicitor Peter Layman and Administrative Assistant Juli Lemak.  Mayor Michael G. Nasatka was absent. 

Visitors:

Adrienne Fors, representative from Waste Management, provided a landfill update to Council.

Public Works Report:

All Council Members were given a copy of Public Works Director Steven Bender’s October report to review.  

Brenda L. Quinn, 105 South Robinson Avenue, requested to have two (2) adjoining parking meters bagged in front of her property.  Councilman Robert O’Donnell made a motion to have the two (2) meters bagged in front of 105 South Robinson Avenue, seconded by Councilwoman Tammy Kemp.  The motion passed unanimous by roll call.

 

An educational handout from Penn State Extension explaining the Municipal Separate Storm Sewer System (MS4) and National Pollution Discharge Elimination System (NPDES) was received by Council. 

 

Debra Gibbs, 635 Williams Street, with a primary residence in New Jersey, submitted a Handicapped Parking Sign Application.  No action was taken on this matter. 

 

Zoning Report:

All Council Members were given a copy of Zoning/Codes Office’s October report.

Council received notification that Permit Manager will be updated to a web-based version

at no cost to the Borough. 

 

The Zoning Hearing Board will meet on Thursday, November 7, 2019 at 7:00 P.M. to hear the application of Wind Drift Real Estate’s variance request for 522/524 George Street.

 


Police Report:

All Council Members were given a copy of the Slate Belt Regional Police minutes from their meetings on September 3, 2019 and October 1, 2019, agendas from October 1, 2019 and October 17, 2019 and September report.

 

The Police Department submitted a request to rent one (1) garage bay at 44 West Bell Avenue.  This matter was tabled, no action was taken at this time.

 

Fire Chief's Report:

 

Fire Chief Parsons reported the fire company received ten (10) calls for the month of October.  The total hours spent on drills was 208 and 276 hours on calls for a total of 484 man hours. 

 

The revised final Lease Agreement for the new fire station was provided to Council for signature.

 

The fire station dedication and open house is Saturday, November 16, 2019 at 12:00 P.M.

 

Minutes:

Councilwoman Josephine Hildabrant made a motion to approve the Minutes for the Council Meeting of Tuesday, October 1, 2019, seconded by Councilman Robert O’Donnell.  The motion passed unanimous by roll call.

Council was given the agenda and information materials from the Park Board Meeting of October 15, 2019 and meeting minutes from September 17, 2019. 

Council received the Slate Belt Council of Governments (SBCOG) meeting minutes from

October 23, 2019, Northampton Tax Collection Committee agenda from October 10, 2019, Slate Belt Chamber of Commerce Economic Development Committee meeting minutes from April 23, 2019 and agenda from October 29, 2019.

 

Correspondence:

 

Lehigh Valley Planning Commission- Review letter for the Upper Mount Bethel Township Draft Act 537 Sewage Facilities Plan. 

Bonnie Price, 323 West Applegate Avenue, sent a letter of thanks.  

Councilwoman Tammy Kemp made a motion to renew the membership with the SBCOG, seconded by Councilwoman Janell Connolly.   The motion passed unanimous by roll call.


Mayor’s Report:

Nothing to report.

 

Planning Commission:

 

            The Northampton County Conservation District (NCCD) sent a notice of termination approval letter and erosion and sediment control plan technical review for the construction of the Slate Belt YMCA. 

 

Solicitor’s Report:

 

Nothing to report.

 

Sanitation, Solid Waste & Recycling:

 

All Council Members were given a copy of the Wastewater Treatment Plant’s October report. 

 

All Council Members were provided with the Wastewater Treatment Plant Committee report dated November 4, 2019.  

A letter of ownership and letter of commitment were sent to the Pennsylvania Department of Community and Economic Development for the Pennsylvania Small Water & Sewer Program Grant Application.

 

Councilwoman Josephine Hildabrant made a motion to approve Resolution #2019-07 to proceed with the PA Small Water and Sewer Grants, seconded by Councilman Robert O’Donnell.  The motion passed unanimous by roll call.

 

Councilman Scott Brumbaugh made a motion to approve the estimate from George’s Plumbing for $4,585.00 for a water valve repair, seconded by Councilman Robert O’Donnell.  The motion passed unanimous by roll call.

 

Councilman Robert O’Donnell made a motion for Borough Solicitor Peter Layman to amend the Sewer Ordinance to reflect a $3.00 rate increase to the quarter base rate of $96.00 to $99.00, as determined by a rate study conducted by the Borough’s Wastewater Engineers, effective January 1, 2020, seconded by Councilwoman Josephine Hildabrant.  The motion passed unanimous by roll call.   

 

 

Finance, Tax Exoneration, Insurance & Personnel:

 

All Council Members were given a copy of the October Treasury Report as prepared by Borough Manager/Treasurer Zmoda.  Councilman Robert O’Donnell made a motion to accept the Treasury Report as prepared, seconded by Councilwoman Josephine Hildabrant.  The motion passed unanimous by roll call.

Council received two (2) notifications from Kevin C. Reed, Esq. of King, Spry, Herman, Freund & Faul LLC. indicating that both the Authority’s Bond and the Borough’s Bond deals had closed.

Stantec Consulting Services, Inc. sent meeting minutes from October 30, 2019 and final report number 2 for the Redevelopment Assistance Capital Program Grant.   

Property & Utilities:

 

Councilwoman Roberta Cowley made a motion to approve two (2) invoices from Snyder Technologies, one (1) invoice for the amount of $1,560.00 to upgrade the Borough Secretary’s PC; the Park’s office PC; the Waste Water Treatment Plant’s PC and the sewer gate control PC, the second invoice for the amount of $2,600.00 for replacing the router in the Park’s office, seconded by Councilman Robert O’Donnell.  The motion passed unanimous by roll call.

Community Outreach:

 

The Slate Belt Rising Steering Committee agenda from October 10, 2019, minutes from September 12, 2019 and September monthly report were received.

The Downtown Revitalization Steering Committee Meeting will be held on Monday, November 18, 2019 at 6:30 P.M. at the Borough Hall. 

All Council Members were provided with Borough Administrative Assistant Juli Lemak’s October feral cat report. 

 

The holiday tree lighting ceremony will be held on Tuesday, December 3, 2019 at 6:30 P.M in front of the Borough Hall. 

 

Councilman Robert O’Donnell made a motion to have the Borough Christmas lights on from Friday, November 29, 2019 to and including Sunday, December 31, 2019, seconded by Councilwoman Tammy Kemp.  The motion passed unanimous by roll call.

The Community Holiday party will be held on Friday, December 6, 2019 at 6:30 P.M. at the Community Center in Weona Park. 

 

 

Borough Manager’s Report:

 

The Slate Belt Regional call log for stray dogs and the Pennsylvania State Association of Boroughs Legislative Update were provided to Council.

Council Members were given a copy of Borough Manager Zmoda’s October report.

 

Payment of Bills:

 

The following bills were presented for payment:  General Fund, $24,172.28; Sewer Fund, $69,016.65; Reserve Money Market Fund, $307,429.90; NORCO DCED Gaming Revenue $25,493.40 and DCNR Pool Feasibility, $1,626.90.  Councilman Robert O’Donnell made a motion to pay the bills

as presented, seconded by Councilwoman Josephine Hildabrant.  The motion passed unanimous by roll call.

 

Executive Session:

 

Councilman Robert O’Donnell made a motion to go into Executive Session to discuss personnel issues, seconded by Councilwoman Roberta Cowley.  The motion passed unanimous by voice vote.  Council went into Executive Session at 7:59 P.M. and reconvened at 8:24 P.M.

 

Special Note:  Borough Administrative Assistant Juli Lemak left the meeting at 7:59 P.M. and the rest of the minutes were taken by Borough Manager Robin Zmoda. 

 

Adjournment

 

Councilwoman Tammy Kemp made a motion to adjourn, seconded by Councilman Scott Brumbaugh.  The motion passed unanimous by voice vote.  Council meeting adjourned at 8:25 P.M.
