Tuesday 27th of November 2018 - Borough Council Special Meeting

           

           

            Pen Argyl Borough Council held a Special Council Meeting on Tuesday, November 27, 2018 at

7:00 P. M. in the Fire Hall for the purpose of adopting a Tentative 2019 Budget and for General Purposes.

 

Pledge of Allegiance:

 

            Council President Joseph LeDonne opened the Council Meeting with the Pledge of Allegiance. 

 

Roll Call:

 

            Council Members present and responding to roll call were:  Joseph LeDonne, Tammy Kemp, Michael Nasatka Jr., Janell Connolly, Charles Kandl Jr., Roberta Cowley, Josephine Hildabrant and Robert O'Donnell.

 

            Also present were Borough Solicitor Peter Layman, Borough Manager Robin Zmoda and Borough Secretary Dolores Savitz.

 

Visitors:

 

            None

 

Executive Session:     

           

            Councilwoman Tammy Kemp made a motion to go into Executive Session to discuss the wages for the management employees for the year 2019, seconded by Councilwoman Josephine Hildabrant.  Unanimous by voice vote.  Council went into Executive Session at

7:04 P. M. and reconvened at 7:49 P. M.

 

 

Discussion and Tentative Adoption of Year 2019 Budget:    

 

                                     General Fund - $1,866,055.00 - 12 Mills (1 Mill increase)

                                        Sewer Fund - $1,869,450.00

                                 Garbage Fund - $438,200.00

                                     State Fund - $201,843.00

                                  Reserve Fund - $3,507,200.00

 

 

                                               Tax Structure

                              Real Estate Tax Millage - 12 Mills

                                                 Per Capita - $ 5.00

                            Local Services Tax (LST) - $52.00

            Real Estate Transfer Tax - 1% - Shared Equally with School District

                     Earned Income Tax - 1% - Shared Equally with School District

                        Sewer Rental Fee - $96.00 Minimum Quarterly Charge per Unit/10,000 Gallons

                                                      $13.50 per Thousand Gallon over 10,000 Gallons

                               Garbage Fee - Garbage Fee Waived for year 2019

 

            The Borough's Assessment Valuation for 2019 is $67,113,200: 2018 was $67,092.500;

2017 Assessment was $65,572,400; 2016 was $67,524,800 and 2015 was $67,645,400.  One (1)

Mill equals $67,113.20, less 7% uncollectible, collectible amount is $62,415.27.

 

            Prior years Millage was 9.75 Mills from year 2011 to and including year 2015; year 2016 was 10.25; year 2017 and 2018 was 11 Mills.

 

            Councilman Robert O'Donnell made a motion to adopt the Tentative Year 2019 Budget with a 1.5% wage increase for management employees and up to $68,000 from the Borough Reserve Fund, seconded by Councilman Charles Kandl Jr.  Unanimous vote by roll call. 

 

            Councilwoman Roberta Cowley made a motion to adopt the Tax Structure for year 2019 with the one (1) mill increase, seconded by Councilman Michael Nasatka Jr.  Council Members voting in favor of the motion were:  Joseph LeDonne, Michael Nasatka Jr., Charles Kandl Jr., Roberta Cowley, Josephine Hildabrant and Robert O'Donnell.  Council Members voting no were:  Tammy Kemp and Janell Connolly. There being six (6) yes votes and two (no) votes the motion carried.

 

Millage Ordinance and also to suspend Residential Garbage Charges:

 

            Councilman Charles Kandl Jr. made a motion to authorize Borough Solicitor Layman to prepare and advertise the necessary ordinances for the 12.00 Tax Millage and also to suspend residential garbage charges under Section 60-4D for the calendar year of 2019 for adoption at the Council Meeting of Tuesday, December 11, 2018, seconded by Councilman Michael Nasatka Jr.  Unanimous by roll call vote.

 

Buy back of two (2) weeks unused vacation:

            Councilman Charles Kandl Jr. made a motion to buy back two (2) unused weeks vacation for management employees, seconded by Councilwoman Janell Connolly.  Council Members voting in favor of the motion were:  Joseph LeDonne, Michael Nasatka Jr., Janell Connolly, Charles Kandl Jr., Roberta Cowley, Josephine Hildabrant and Robert O'Donnell.  Councilwoman Tammy Kemp voted no.  There being seven (7) yes votes and one (1) no vote the motion carried.

 

Painting of Borough Hall sign:

            One (1) bid was received for painting the Borough Hall sign from JJJ Martin LLC, 983 Engler Road, Nazareth, PA 18064.  The total bid was for $1,600.00 which includes all material, equipment and labor. Councilman Charles Kandl Jr. made a motion to accept the bid of $1,600.00 as submitted, seconded by Councilman Michael Nasatka Jr.  Unanimous vote by roll call. 

 

Executive Session:

            Councilwoman Janell Connolly made a motion to go into Executive Session for possible litigation issues, seconded by Councilman Michael Nasatka Jr.  Council Members voting in favor of the motion by voice vote were: Joseph LeDonne, Tammy Kemp, Michael Nasatka Jr., Janell Connolly, Roberta Cowley, Josephine Hildabrant and Robert O'Donnell.  Councilman Charles Kandl Jr. voted no.  There being seven (7) yes votes and one (1) no vote the motion carried.  Council went into Executive Session at 8:08 P. M. and reconvened at 8:11 P. M.  Special Note:  Borough Secretary Savitz left at 8:09 P. M. and the rest of the minutes were taken by Borough Manager Zmoda.

 

Settlement with James D. Morrisey:

            Councilman Michael Nasatka Jr. made a motion to settle with James D. Morrisey in the amount of $15,000 to resolve the sidewalk issues on B Street, seconded by Councilwoman Roberta Cowley.  Unanimous by voice vote.

 

Adjournment:

            Councilwoman Roberta Cowley made a motion to adjourn, seconded by Councilman Michael Nasatka Jr.  Unanimous by voice vote.  Council Meeting adjourned at 8:20 P. M.
