Tuesday 5th of September 2017 - Borough Council Meeting

Pen Argyl Borough Council held their Meeting for September on Tuesday, September 5, 2017 at 7:00 P. M. in the Fire Hall.


Pledge of Allegiance:

            Council President Michael Nasatka opened the Council Meeting with the Pledge of Allegiance.                                                                                                               

Roll Call:

            Council Members present and responding to roll call were:  Michael Nasatka, Dean Minnich, Joseph LeDonne, Janell Connolly, Charles Kandl Jr., Roberta Cowley, Robert O'Donnell and Tammy Kemp.


            Also present were Mayor Mikal Sabatine, Borough Solicitor Peter Layman and Borough Manager Robin Zmoda.



            Jeff Fox, 437 William Street, praised Borough Council and staff for all that is accomplished in this community with the limited resources of money and staff.  He encouraged Council to include succession planning in order to plan for the future.  Mr. Fox also cautioned any candidates for Council to understand there are many facets to the Borough and concentrating on one issue could cause fiscal harm to the overall financial health of the borough.


            Pat Smale, 212 George Street, Debra Eichner, 210 George Street and Linda Irwin, 216 George Street were at meeting to discuss the 200 block of Myrtle Street.  Ms. Smale spoke on behalf of those attending.  Council had been given a letter in their packets regarding Myrtle Street that was signed by twelve (12) residents of the area.  Ms. Smale inquired about why the 300 and 400 blocks were paved but not the 200 block.  There was discussion about ordained streets, non ordained streets and paper alleys.  Zmoda stated she was researching the ordinance she found regarding the ordination of Myrtle Street and would like to recommend that the Borough Council authorize her to get a proposal from the Borough engineers to do a survey on the area as it is stated in the ordinance and map it out so the Borough can evaluate and plan the next step.  Councilman Robert O'Donnell made a motion to authorize the Borough Manager to get a cost proposal to survey and plot out the ordained portion of Myrtle Street, seconded by Councilwoman Roberta Cowley.  Unanimous by roll call vote. 


            Adrienne Fors, representative of Waste Management, presented to Council information on upcoming events being held by the landfill. 


Public Works Report:

            All Council Members were given a copy of Public Works Steven Bender's August report to review.  Bender was present.


            Councilwoman Roberta Cowley made a motion to authorize Bender to hire Bruce George Construction to repair the areas of Savercool Avenue with three (3) depressions for no more than $10,000.00, seconded by Councilman Charles Kandl Jr.  Unanimous by roll call vote. 

             Borough Council was given copies of PennDOT's most recent S. Robinson Avenue turnback proposal.  Zmoda pointed out that the new estimated cost includes replacement of four (4) ADA ramps on E Street.  Zmoda also stated that the PennDOT representative indicated that  the Borough could in the meantime place "wedges" of macadam at these ramps to prevent any incidents, Zmoda had asked for that in writing, but has not as of today received any.  Zmoda recommended a further review by the engineer.  Councilman Joseph LeDonne questioned the handicap ramp count.  Council directed Zmoda to review with engineer.


            Council was given a copy of correspondence from Chade T. Sankari of PennDOT who declined the Borough's request for a traffic study to place "No Truck" signs on George Street.  The letter indicated that restrictions already existed under Pennsylvania Title 75 4908 and residents should call the Regional Police if trucks are going on the roadway.  Councilwoman Cowley asked if we had communicated with Techobloc regarding the truck issue.  Zmoda indicated that she recently was given a contact and will be reaching out to them.


            Council was given copies of information pertaining to the Carousel Facade Project.


            Council was also given a copy of the B Street punchlist and informed Council these outstanding items and issues were the reason the application for payment was declined by the Borough Engineer at this time.


            Council was also informed that the Borough's grant application for the County Investment Partnership Program for the salt shed has been recommended for funding in the amount of $30,500.00. 


Zoning Report:                       

            All Council Members were given a copy of Zoning/Code Office's August report to review.


Police Report

            Council was given copies of the minutes of the July 5, 2017 meeting of the Slate Belt Regional Police Department and also the July Police Reports.


Council President Michael Nasatka reported that the Slate Belt Regional Police Commission and Chief Mettin are working on the 2018 Budget.  Presently, they are reviewing the formula that computes the dollar amount each municipality pays for service. One of the issues is how incidents are recorded.  SBRPD record the Borough's moving permits and parking permits as incidents.  Nasatka relayed that in August, Pen Argyl had 178 total incidents, Plainfield had 221 and Wind Gap had 211.  If you remove the moving permits and parking tickets the Borough's incidents get lower to 137.   It was recommended to no longer send moving permits to the SBRPD and to open a discussion on the parking meters. He cautioned that the parking meters could affect the Borough financially within the police budget. The other method would be to weigh the calls so criminal acts would be weighted more than moving permits. The Chief has already begun to review that process and has emailed that information onto the Police Commission to begin review.   Mayor Sabatine requested that the Borough Manager provide himself and Council President the parking meter revenue for 2016 and year to date 2017.  Council directed Zmoda to no longer send moving permits to the SBRPD. Zmoda also suggested that she provide meter revenue back several years to better understand the revenue and expenditure impact of meters.


Fire Chief Report:                   

            Fire Chief Dean Parsons reported that the fire company received eleven (11) calls for August.  They spent 319 hours on calls and 298 hours on drills. 


Chief Parsons asked if there was an update on the fire station, Councilman Nasatka said no.


            Chief Parsons inquired about the issues regarding the address concerns by the County 911 Center.  Zmoda stated she had contacted the property owners and was waiting for a call from the County.



            Councilman Charles Kandl Jr. made a motion to approve the Minutes for Regular Council Meeting of August 1, 2017, seconded by Councilman Joseph LeDonne.  Members voting in favor of the motion were:  Joseph LeDonne, Janell Connolly, Charles Kandl Jr., Roberta Cowley, Dean Minnich, Tammy Kemp and Robert O'Donnell.  Council President Michael Nasatka voted abstained.  There being seven (7) yes votes and one (1) abstained vote the motion carried.


            Council was also given copies of minutes from Park Board Meeting of July 18, 2017 and SBCOG Meeting of August 23, 2017. 


            Zmoda pointed out the information in the Park Board minutes regarding the Northern Tier Trail questionnaire. 



Plainfield Township will be hosting Harassment Training in October and several employees and council members will be attending.


            Correspondence was received regarding a block party on the 200 block of W.  Laurel Avenue on October 28, 2017. Councilman Robert O'Donnell made a motion to allow for Craig and Ann Ealey, 209 W. Laurel Avenue to close off W. Laurel Avenue between N. Heller Avenue and N. Lobb Avenue on October 28, 2017 on the condition that it does not interfere with the school bussing of students, seconded by Councilman Charles Kandl Jr.   Councilwoman Janelle Connolly expressed concern about the busses transporting the team and band from the Bangor vs. Pen Argyl Football game that day.  Zmoda said she will touch base with the school to check on logistics.  Unanimous by roll call vote. 


            Council was given a copy of correspondence from Faith United Presbyterian Church regarding their annual Apple Festival.  Councilman Robert O'Donnell made a motion to allow Faith United Presbyterian Church to close S. Heller Avenue from Pennsylvania Avenue to the alley behind the church on Saturday, October 7, 2017 from 1:00 P. M. to 9:00 P.M. for their annual Apple Festival, seconded by Councilman Dean Minnich.  Unanimous by roll call vote.


            Also received was correspondence regarding Waste Management's permit renewal and a thank you from Immaculate Conception School for the Borough's assistance with their Mayfair.


Mayor's Report:

            Mayor Sabatine reported the Summer Sounds Program has ended for the season but plans for next year are already beginning.  Anyone with information or suggestions for music should contact the Mayor or members of the Park Board.


            Mayor Sabatine also reminded Council to keep the first Friday of December opened for the Annual Borough Holiday Party for families.  Volunteers will be needed.


            He also thanked Chief Parsons and Lookout Fire Company for another wonderful Labor Day carnival and parade.


Solicitor's Report:

            Borough Solicitor Layman requested an Executive Session before Council adjourned for possible litigation purposes.

Sanitation, Solid Waste & Recycling

            Council was given a copy of the Wastewater Treatment Plant's August report.


Also given to Council were copies of the August 7, 2017 Engineer Report and the Municipal Sewer Authority Minutes from their meeting of June 5, 2017. 



            Zmoda had copies of proposals from the engineering firms that responded to the request for proposals.  She will set up interviews with them on September 25, 2017. 


Finance, Tax Exoneration, Insurance & Personnel:   

            All Council Members were given a copy of the Treasury Report as prepared and submitted by Borough Manager/Treasurer Zmoda.  Councilman Dean Minnich. made a motion to accept the Treasury Report as prepared, seconded by Councilwoman Roberta Cowley.  Unanimous by roll call vote.


            Council was given information on the Minimum Obligation (MMO) for non-uniformed members for the plan year of 2018; total amount of obligation is $36,433.00.


            The Annual Worker's Compensation Audit was completed.


            Wasterwater Plant Supervisor Jeffrey Markovitz met with a representative of Kobalt Construction on C Street and the sanitary lid issue will be resolved.


Property & Utilities:

            Architect for the Borough Hall renovations of old police station is finishing up with the coordination of his consultants.


Community Outreach:

            Council was given copies of the minutes of the Slate Belt Rising Steering Committee meeting of 8/17/2017.  Mr. Stephen Reider, Director of the program was present to answer any questions.


            Community Yard Sales will be September 15, 2017 through September 17, 2017.


Borough Manager's Report:              

            Borough Manager Zmoda is still researching the street light issue and costs.


            All employees have been signed up for CPR classes in October.


Council President Michael Nasatka inquired about automatic defibrillators for all

Borough Buildings.  He would like to see one (1) defibrillator in each building and one (1) at Weona Park.  Councilman Robert O'Donnell made a motion to purchase four (4) Automatic Defibrillators with mounting equipment, seconded by Councilman Dean Minnich.  Unanimous by roll call vote.


Zmoda reported all Real Estate Delinquent letters have been mailed. 


            Zmoda reported on the Express Times circular distribution meeting.


            Council was given a handout regarding the Rain Garden Workshop to be held September 26, 2017 at 6:00 P.M. at Borough Hall.


            Zmoda requested an executive session for personnel and potential litigation.


Payment of Bills:        

            The following bills were presented for payment:  General Fund, $15,990.93; Sewer Fund, $64,976.69; State Fund, $48,500.00 and Reserve Money Market Fund, $44,097.71.  Councilman Robert O'Donnell made a motion to pay the bills as presented, seconded by Councilman Joseph LeDonne.  Unanimous vote by roll call. 


Executive Session:                  

            Councilman Dean Minnich made a motion to go into Executive Session for personnel issues and possible litigation, seconded by Councilwoman Roberta Cowley.   Unanimous by roll call vote.  Council went into Executive Session at 8:21 P. M. and reconvened at 8:58 P. M.



            Councilwoman Tammy Kemp made a motion to adjourn, seconded by Councilwoman Roberta Cowley.  Unanimous by voice vote.  Council Meeting adjourned at 8:59 P. M.
