Pen Argyl Borough Council held their Meeting for April on Monday, April 11, 2022
at 7:00 P. M. at Lookout Fire Hall Building.
Pledge of Allegiance:
Council President Joseph LeDonne opened the Council Meeting with the Pledge of Allegiance.
Roll Call:
Council Members present and responding to roll call: Joseph LeDonne, Tammy Kemp, Charles Kandl Jr., John Apgar, Janell Connolly, Stephanie Cooper and Josephine Hildabrant. Councilman Scott Brumbaugh was absent.
Also present were Mayor Steven Male, Borough Solicitor Peter Layman, Borough Manager Robin Zmoda and Borough Secretary Juli Lemak.
Visitors:
Larry Hildabrant, 211 N. Lobb Avenue, expressed his concerns regarding 314 N. Lobb Avenue, he suspects pool water is sent into the storm drains from that property.
John and Deborah Montoro, 411 W. Applegate Avenue, expressed their concerns for the possibility of an apartment complex at 412 W. Applegate Avenue. Manager Zmoda informed them only sketch plans have been submitted, nothing actionable.
Tom Carlo, 301 S. Robinson Avenue, asked if there is an update on the Middletown Road land development project, Manager Zmoda informed him no formal plans have been submitted. He also asked if the rehab facility was approved on W. Main Street, Council President LeDonne informed him the project was denied.
Council President LeDonne read an email update to all Council Members from Adrienne Fors, Waste Management Representative.
Public Works Report:
All Council Members were given a copy of Public Works Director Steven Bender's March report to review.
Councilman Charles Kandl Jr. made a motion to approve the handicapped parking application for Penny Hall, 425 W. Main Street, seconded by Councilwoman Stephanie Cooper. Unanimous by roll call.
Councilman Charles Kandl Jr. made a motion to advertise for bids for upgrades to the park concession stands, partially funded through the Livable Landscape grant and the Local Share Account grant, seconded by Councilwoman Tammy Kemp. Unanimous by roll call.
All Council Members received a draft copy of the Pool Pals minutes from April 4, 2022, and the Pool Pals fundraising totals.
Zoning Report:
All Council Members were given a copy of Zoning/Codes Office's March report.
All Council Members received the Zoning Hearing Board’s meeting minutes from
March 24, 2022.
Councilwoman Tammy Kemp made a motion to advertise the ordinance for vacant and abandon properties and storefronts, conditionally based on changing “Bangor” to “Pen Argyl” and changing “mortgage” to “mortgagee/landowner”, seconded by Councilwoman Josephine Hildabrant. Voting in favor of the motion were Council Members Tammy Kemp, Janell Connolly, Stephanie Cooper, Josephine Hildabrant and John Apgar. Council Members Joseph LeDonne and Charles Kandl Jr. voted no. There being five (5) yes votes and two (2) no votes, the motion passed.
All Council Members received the agenda for the Zoning Committee meeting on April 7, 2022.
Police Report:
All Council Members were given a copy of the Slate Belt Regional Police Commission’s minutes for their meeting of February 17, 2022, February calls for service and the March 17, 2022 agenda.
Councilman Charles Kandl Jr. made a motion to approve the Amended Charter Agreement draft, seconded by Councilwoman Stephanie Cooper. Unanimous by roll call.
Fire Chief's Report:
Fire Chief Parsons was present and reported the fire company responded to 7 calls for the month of March, spent 158 hours on calls and 204 hours on drills.
Minutes:
Councilwoman Tammy Kemp made a motion to approve the Minutes for the Council Meeting of March 14, 2022, conditionally with a correction on page 1, under the section of “Agenda Change” to be written as “Councilwoman Tammy Kemp made a motion to approve the revised agenda to include
the additions of: “Park Board recommendations for Members and WM check presentation”; “Fire Truck (M34)”; “Scope of work for infiltration (M34)”, and “Salt shed”, these items were added last minute due to requests for additional items, seconded by Councilwoman Josephine Hildabrant. Unanimous by roll call.
Correspondence:
Fran Rowley, Immaculate Conception School, requested a street closure for their annual Mayfair to be held on May 12, 2022. They are requesting to close N. Heller Avenue from W. Bell Avenue to W. Babbitt Avenue from 8:15 A. M. to 2:00 P. M. Councilwoman Tammy Kemp made a motion to grant permission as requested for the road closure, seconded by Councilwoman Josephine Hildabrant. Unanimous by roll call.
Mayor's Report:
Mayor Male informed all Council Members that he will be able to secure a dumpster for a town wide cleanup of trash in the streets, date is to be determined.
Planning Commission:
All Council Members received the Plan Slate Belt Multi-Municipal Comprehensive Plan Steering Committee’s agenda from April 6, 2022, and March 2, 2022 minutes.
All Council Members received a copy of correspondence from the Lehigh Valley Planning Commission to Bangor Borough for the land development application of Budget Self Storage located at 725 Bill Scott Blvd.
All Council Members also received a copy of correspondence from the Lehigh Valley Planning Commission to Plainfield Township, reviewing their subdivision and land development ordinance amendment to the sections of submission requirements and street construction standards.

Nothing for open session.

Sanitation, Solid Waste & Recycling:
All Council Members were given a copy of the Wastewater Treatment Plant’s March report.
Finance, Tax Exoneration & Insurance:
Councilman Charles Kandl Jr. made a motion to accept the March treasurer report as prepared and submitted by Borough Manager/Treasurer Zmoda, seconded by Councilwoman Josephine Hildabrant. Unanimous by roll call.
All Council Members received a copy of the 2021 Municipal Annual Audit and Financial Report, as presented to the Department of Community & Economic Development.
Councilman Charles Kandl Jr. made a motion to renew the Borough’s insurance with WSA Insurance, for the total premium rate of $85,065.00, seconded by Councilman John Apgar. Unanimous by roll call.
Councilman Charles Kandl Jr. made a motion to approve the schedule change for personnel sharing of John Spadoni between the Public Works department and the Wastewater Department, moving from alternating weeks, to Monday, Tuesday and Wednesday at Wastewater Treatment Plant and Thursday and Friday at Public Works Department, seconded by Councilman John Apgar. Unanimous by roll call.
Property & Utilities:
Councilman John Apgar made a motion to proceed to hire the Brothers That Just Do Gutters to repair the Borough Hall’s gutters for $2,011.50, seconded by Councilwoman Stephanie Cooper. Unanimous by roll call.
All Council Members received an assessment letter for the Community Center from John E Pugliesi, PE.
Community Outreach:
Borough Secretary Juli Lemak provided Council with the March feral cat report.
Borough Manager's Report:
All Council Members were given a copy of Borough Manager Zmoda’s March report.
Payment of Bills:
The following bills were presented for payment: General Fund, $209,575.97; Sewer Fund, $72,316.12; State Fund $8,271.14 and Reserve Money Market Fund, $9,888.65. Councilman Charles Kandl Jr. made a motion to pay the bills as presented, seconded by Councilman John Apgar. Unanimous by roll call.
Executive Session:
Councilwoman Tammy Kemp made a motion to go into Executive Session to discuss potential litigation, seconded by Councilwoman Stephanie Cooper. Unanimous by voice vote.
Council went into Executive Session at 8:47 P.M. and reconvened at 9:31 P.M.

Councilwoman Tammy Kemp made a motion to adjourn, seconded by Councilman Stephanie Cooper. Unanimous by voice vote. Council meeting adjourned at 9:32 P.M.
