Tuesday 6th of July 2021 - Council meeting

            Pen Argyl Borough Council held their Regular Council Meeting on Tuesday, July 6, 2021

at 7:00 P. M. in the Weona Park Community Center.

 

Pledge of Allegiance:

 

            Council President Joseph LeDonne opened the Council Meeting with the Pledge of Allegiance.

 

Roll Call:

 

Council Members present and responding to roll call: Joseph LeDonne, Tammy Kemp, Scott Brumbaugh, John Apgar, Stephanie Cooper, Janell Connolly, and Josephine Hildabrant.  Council Member Charles Kandl Jr. was absent.

 

Also, present were Mayor Stephen Male, Borough Solicitor Peter Layman, Borough Manager Robin Zmoda and Borough Secretary Juli Lemak.   

Visitors:

 

Ethan Habrial, 100 A Street, expressed his frustration with the permitting requirements for his solar panel permit application. 

 

Public Works:

 

            All Council Members were given a copy of Public Works Director Steven Bender's June report to review. 

           

All Council Members received a report of all the volunteers and donors from the Centennial Celebration.

 

Councilwoman Tammy Kemp made a motion to approve the handicapped parking application for Joseph Capone, 309 Pen Argyl Street, seconded by Councilman John Apgar.  Unanimous by roll call.

 

Zoning Report:

 

            All Council Members were given a copy of Zoning/Codes Office's June report, the updated property maintenance log, and the property maintenance violation procedure.

 

            All Council Members received copies of the May 13, 2021 Zoning Hearing minutes.

 

Police Report:

 

All Council Members were given a copy of the Slate Belt Regional Police minutes from the

May 20, 2021 meeting, the July 17, 2021 agenda and the May calls for service. 

 

 

All Council Members received a copy of correspondence from Plainfield Township Board of Supervisors to the Slate Belt Regional Police (SBRP), notifying them that the lease agreement will expire at the end of the 2021 calendar/fiscal year, and they wish to re-negotiate the lease. 

 

            Councilman Scott Brumbaugh made a motion to appoint Borough Manager Zmoda as the representative for Pen Agryl Borough to the SBRP Commission for the lease renewal negotiations, seconded by Councilwoman Josephine Hildabrant.  Unanimous by roll call.

 

Councilwoman Stephanie Cooper made a motion to sign the agreement between Pen Argyl and the SBRP to forward the $79,424.00 LSA grant award for Pen Argyl’s Regional Police Vehicles Project to the SBRP, seconded by Councilwoman Tammy Kemp.  Unanimous by roll call.

 

Fire Chief's Report:

 

            Fire Chief Parsons was present and reported the fire company responded to 16 calls for the month of June, spent 348 hours on calls and 185 hours on drills. 

 

            Councilman John Apgar made a motion to conditionally approve a beer stand at the Lookout Fire Company’s Labor Day celebration, pending state approval and licensing, seconded by Councilman Scott Brumbaugh.  Unanimous by roll call.

 

Minutes:

 

Councilwoman Tammy Kemp made a motion to approve the Minutes for the Council Meeting of June 1, 2021, seconded by Councilwoman Josephine Hildabrant. Unanimous by roll call.

All Council Members received copies of the Park Board’s June 8, 2021 agenda and May 11, 2021 minutes.

Correspondence:

 

Councilwoman Tammy Kemp made a motion to approve the YMCA Special Event Application for the “Slate Belt Sprint” on September 4, 2020, from 8:15 A.M. to 9:15 A.M., seconded by Councilwoman Stephanie Cooper.  Unanimous by roll call.

 

Mayor's Report:

 

            All Council Members received a copy of the Slate Belt Council of Government’s (SBCOG)

 May 26, 2021 and June 23, 2021 meeting minutes. 

 

Mayor Male reported the SBCOG purchased a leaf vac for $9,000.00 for the communities to rent for $75.00 per day.  The Public Works department has spread millings at the park, and has requested more millings from Penn DOT.

 

 Planning Commission:

 

            Councilwoman Tammy Kemp made a motion to conditionally approve the minor subdivision application for James & Suzanne Santo, 409-411 North Schanck Avenue, conditioned upon the recommendations by the Barry Isett & Associates Inc. review letter dated June 18, 2021 and

May 27, 2021 and the Collier Engineering & Design review letter dated June 7, 2021, seconded by Councilwoman Stephanie Cooper.  Unanimous by roll call.

 

            Councilwoman Tammy Kemp made a motion to conditionally approve the minor subdivision application for James & Suzanne Santo, 409-411 W Mountain Avenue, conditioned upon the recommendations made by Barry Isett & Associates Inc. review letter dated June 18, 2021 and

May 27, 2021 and the Collier Engineering & Design review letter dated June 7, 2021, seconded by Councilman John Apgar.  Unanimous by roll call.

 

            All Council Members received a copy of the Lehigh Valley Planning Commission’s (LVPC) review letter for the subdivision application at 613-615 South Main Street in Bangor, and their review letter for Bangor’s zoning ordinance amendment.  They also received a copy of the LVPC’s review letter to Plainfield Township for their zoning ordinance amendment for additional requirements for warehouse, wholesale, storage, and distribution uses.

 

            All Council Members received the Plan Slate Belt’s Multi-Municipal Comprehensive Plan Steering Committee Meeting agenda from June 2, 2021 and minutes from the November 4, 2020 meeting.

 

Solicitor:

 

Nothing to report.

 

Sanitation, Solid Waste & Recycling:

 

            All Council Members were given a copy of the Wastewater Treatment Plant’s June report.

           

All Council Members received a letter in opposition to the proposed Senate Bill No. 597 written by the Eastern Pennsylvania Water Pollution Control Operators Association.   

 

Councilwoman Janell Connolly made a motion to write a letter in opposition to Senate Bill

No. 597, seconded by Councilwoman Josephine Hildabrant.  Unanimous by roll call. 

 

Finance, Tax Exoneration & Insurance:         

 

All Council Members were given a copy of the June Treasury Report as prepared by Borough Manager/Treasurer Zmoda.  Councilwoman Tammy Kemp made a motion to accept the Treasury Report as prepared, seconded by Councilwoman Josephine Hildabrant.  Unanimous by roll call.

 

All Council Members received notification from Fidelity Bank the  interest rates were lowered. 

 

All Council Members received correspondence from the Pennsylvania Office of the Budget that the American Rescue Act distribution of $186,180.86 will be deposited into the account on

June 29, 2021.

 

Councilwoman Tammy Kemp made a motion to reabsorb the pre-existing garbage credits of $15.00 or less, seconded by Councilwoman Josephine Hildabrant.  Unanimous by roll call.

 

Property & Utilities:

 

Councilwoman Tammy Kemp made a motion for the Pen Argyl Early Learning Academy,

318 W Applegate Avenue, to use the Borough Hall and the Social Hall as an emergency shelter, seconded by Councilman John Apgar.  Unanimous by roll call.

 

Councilwoman Tammy Kemp made a motion to adopt the Borough’s Memorial policy, seconded by Councilman Scott Brumbaugh.  Unanimous by roll call.

 

Community Outreach:

 

            Council received Slate Belt Rising’s Steering Committee Meeting’s May 13, 2021 agenda and minutes from April 8, 2021. 

 

Borough Manager's Report:

 

Council Members were given a copy of Manager Zmoda’s June report.

 

 

All Council Members received the correspondence from Northampton County regarding the Borough’s continued participation in the Community Development Block Grant (CDBG) Program.  Councilwoman Stephanie Cooper made a motion to sign the Cooperative Agreement to continue in the CDBG program, seconded by Councilman John Apgar.  Unanimous by roll call.

 

Payment of Bills:

 

The following bills were presented for payment:  General Fund, $182,641.50; Sewer Fund, $52,773.33, and Reserve Money Market Fund, $9,970.00.  Councilwoman Josephine Hildabrant made a motion to pay the bills as presented, seconded by Councilman Scott Brumbaugh.  Unanimous by roll call.

 

Executive Session:

 

Councilwoman Tammy Kemp made a motion to go into Executive Session for potential litigation, seconded by Councilman John Apgar. Unanimous by roll call vote.  Council went into Executive Session at 8:09 P.M. and reconvened at 8:35 P.M.

 

Special Note:  Borough Administrative Assistant Juli Lemak left the meeting at 8:09 P.M. and the rest of the minutes were taken by Borough Manager Robin Zmoda. 

 

Adjournment

Councilwoman Josephine Hildabrant made a motion to adjourn, seconded by Councilman Scott Brumbaugh.  Unanimous by voice vote.  Council meeting adjourned at 8:45 P.M.
