Tuesday 4th of May 2021 - Council Meeting

            Pen Argyl Borough Council held their Regular Council Meeting on Tuesday, May 4, 2020

at 7:00 P. M. in the Weona Park Community Center.

 

Pledge of Allegiance:

 

            Council President Joseph LeDonne opened the Council Meeting with the Pledge of Allegiance.

 

Roll Call:

 

Council Members present and responding to roll call: Joseph LeDonne, Tammy Kemp, Scott Brumbaugh, John Apgar, Stephanie Cooper, Janell Connolly, Josephine Hildabrant and Charles Kandl Jr.

 

Also present were Mayor Stephen Male, Borough Solicitor Peter Layman, Borough Manager Robin Zmoda and Borough Secretary Juli Lemak.   

Visitors:

 

Ethan Habrial, 100 A Street, inquired about the status of his solar panel permit application. 

 

Tom Carlo, 306 S. Robinson Avenue, complained to Council Members the speed signs located by Weona Park are not working and the meters are not being paid on S. Robinson Avenue.

 

Public Works:

 

            All Council Members were given a copy of Public Works Director Steven Bender's April report to review. 

           

            Manager Zmoda informed Council Members the Lobb Avenue discussion with Barry Isett & Associates will be at the May Workshop.

 

Councilman Charles Kandl Jr. made a motion to approve Resolution #2021-03, to request the Greenways, Trails and Recreation Program grant of $250,000.00 from the Commonwealth Financing Authority and a commitment of a $44,750.00 match by the Borough to be used for a Weona Park Playground Improvement Project, seconded by Councilwoman Janell Connolly.  Unanimous by roll call.

           

Councilwoman Tammy Kemp made a motion to approve the handicapped parking application for John Hendricks, 500 W. Pennsylvania Avenue, seconded by Councilwoman Stephanie Cooper.  Unanimous by roll call.

 

            Pursuant to Governor Wolf’s lift on Covid-19 restrictions on May 31, 2021, all Council Members did not have any objections to open Weona Park for the 2021 Summer Season. 


Zoning Report:

 

            All Council Members were given a copy of Zoning/Codes Office's April report and the updated property maintenance log.

 

            Council Members received copies of the May 13, 2021 Zoning Hearing legal notices.

           

Police Report:

 

All Council Members were given a copy of the Slate Belt Regional Police minutes from the March 18, 2021 meeting and the April 15, 2021 agenda. 

           

Fire Chief's Report:

 

            Fire Chief Parsons was present and reported the fire company responded to 11 calls for the month of April, spent 226 hours on calls and 166 hours on drills. 

 

Minutes:

 

Councilman Scott Brumbaugh made a motion to approve the Minutes for the Council Meeting of April 6, 2021, seconded by Councilman Charles Kandl Jr. Unanimous by roll call.

All Council Members received copies of the April 13, 2021 Park Board Minutes.

Correspondence:

 

Thomas R. Petrucci, Plainfield Township Manager, sent correspondence acknowledging receipt of Manager Zmoda’s letter dated April 8th, requesting that the Borough will be provided notification of any planning/zoning applications for the CRG Acquisition, LLC proposed Major Subdivision and Land Development that are submitted for the consideration of either the Board of Supervisors, the Planning Commission, or the Zoning Hearing Board.

 

All Council Members received correspondence from the Slate Belt Heritage Center regarding program guidelines and their newsletter, The Heritage Herald.

 

All Council Members received copies of the Lehigh Valley Planning Commission’s Lubrera-Maguire lot line adjustment application’s review letter and Czopoth-Nelson lot line adjustment application’s review letter, both located in Upper Mount Bethel Township. Also, the review letter of Plainfield Township’s Gall Farm Preserve, Phase 1A Land Development application.

 

Mayor's Report:

 

            All Council Members received the Slate Belt Council of Government’s (SBCOG) April 28, 2021 minutes.

 

Mayor Male reported the Public Works Department will begin street sweeping on May 17th. 

 

Planning Commission:

 

            Nothing to report.

 

Solicitor:

 

 Councilman Chuck Kandl Jr. made a motion to approve the SBCOG street sweeper inter-municipal lease agreement, seconded by Councilman Scott Brumbaugh.  Unanimous by roll call.

 

Sanitation, Solid Waste & Recycling:

 

            All Council Members were given a copy of the Wastewater Treatment Plant’s April report and the Sewer Committee’s April 5, 2021 report.

 

Councilman Scott Brumbaugh made a motion to approve ordering a trash pump to replace the broken one through Hilltop Sales & Services for $1,215.00, seconded by Councilwoman Stephanie Cooper.  Unanimous by roll call.

 

Councilwoman Tammy Kemp made a motion to approve the estimate from Buskirk Siding & Repair for overhangs on the sewer plant for $1,400.00, seconded by Councilman Scott Brumbaugh.  Unanimous by roll call.

 

Councilman Charles Kandl made a motion to approve the estimate from Soul Customs to repair the original screw conveyor as a spare for the centrifuge for $1,375.00, seconded by Councilwoman Josephine Hildabrant.  Unanimous by roll call.

 

All Council Members received a landfill update Waste Management.

 

Councilman John Apgar made a motion to accept Colliers Engineering & Design’s proposal to provide property boundary research, topographical survey and street reconstruction design for the proposed E. Babbitt Street sewer extension project for $17,000.00, seconded by Councilman Scott Brumbaugh.  Unanimous by roll call.

 

Sanitation, Solid Waste & Recycling con’t:

 

Councilman Scott Brumbaugh made a motion to accept Colliers Engineering & Design’s proposal for the design and permitting required to replace the force main at Pen Argyl Road, with a parallel line from the pump station to an existing gravity sanitary manhole near A Street for $49,600.00, seconded by Councilman John Apgar.  Unanimous by roll call.

 

All Council Members received notification from Colliers Engineering & Design that they will submit a NPDES Application to the Pennsylvania Department of Environmental Protection for the Wastewater Treatment Plant with discharges into Waltz Creek. 

 

Borough Manager Zmoda informed Council Members the Utility Billing Program has been upgraded.

 

Finance, Tax Exoneration & Insurance:         

 

All Council Members were given a copy of the April Treasury Report as prepared by Borough Manager/Treasurer Zmoda.  Councilman Charles Kandl Jr. made a motion to accept the Treasury Report as prepared, seconded by Councilwoman Tammy Kemp.  Unanimous by roll call.

 

Borough Manager/Treasurer informed all Council Members the 1st Quarter Budget Review was sent via email.

 

All Council Members reviewed a draft Drug and Alcohol Policy.  No action was taken on this matter.

 

Councilman Charles Kandl Jr. made a motion to approve the evaluation and wage model for non-union employees to be used as a model for pay increase, seconded by Councilwoman Janell Connolly.  Voting in favor of the motion was Council Members Joseph LeDonne, Scott Brumbaugh, Janell Connolly, Charles Kandl Jr., Stephanie Cooper, Josephine Hildabrant and John Apgar.  Councilwoman Tammy Kemp voted no.  There being seven (7) yes votes and one (1) no vote, the motion carried. 

 

All Council Members received notification from Benecon that non-federal government employees are eligible for COVID-19 leave tax credits.

 

Property & Utilities:

 

Councilwoman Stephanie Cooper made a motion to approve the proposal from Altronics Security Systems to upgrade the 3G/4G Communicator for $195.00, seconded by Councilwoman Tammy Kemp.  Unanimous by roll call.


All Council Members agreed to allow the opening of Borough Hall to allow visitors to come inside. 

 

Community Outreach:

 

            Borough Secretary Juli Lemak provided Council with the April feral cat report.

 

Council received Slate Belt Rising’s Steering Committee meeting April 8, 2021 agenda and minutes from March 11, 2021. 

 

Centennial Chair Roberta Cowley requested volunteers and cupcakes from Borough Council and Park Board for the Weona Park 100 Centennial event. 

 

Borough Manager's Report:

 

Council Members were given a copy of Manager Zmoda’s April report.

 

Manager Zmoda informed Council Members Pennsylvania State Association of Boroughs is having a virtual conference on June 7th- 8th and she will attend.

 

Payment of Bills:

 

The following bills were presented for payment:  General Fund, $34,170.26; Sewer Fund, $66,819.68, and Reserve Money Market Fund, $2,545.00.   Councilwoman Tammy Kemp made a motion to pay the bills as presented, seconded by Councilwoman Josephine Hildabrant.  Unanimous by roll call.

 

Executive Session:

 

Councilwoman Tammy Kemp Apgar made a motion to go into Executive Session to discuss possible litigation issues, seconded by Councilwoman Josephine Hildabrant. Unanimous by roll call vote.  Council went into Executive Session at 8:24 P.M. and reconvened at 8:50 P.M.

 

Special Note:  Borough Administrative Assistant Juli Lemak left the meeting at 8:24 P.M. and the rest of the minutes were taken by Borough Manager Robin Zmoda. 

 

Adjournment:

 

Councilwoman Tammy Kemp made a motion to adjourn, seconded by Councilman Scott Brumbaugh.  Unanimous by voice vote.  Council adjourned at 8:52 P.M.
