Tuesday 5th of January 2021 - Borough Council Meeting

            Pen Argyl Borough Council held their Meeting for January on Tuesday, January 5, 2021

at 7:00 P. M. via Zoom Remote Meeting.

 

Pledge of Allegiance:

 

            Council President Joseph LeDonne opened the Council Meeting with the Pledge of Allegiance.

 

Roll Call:

 

Council Members present and responding to roll call: Joseph LeDonne, Tammy Kemp, Janell Connolly, Scott Brumbaugh, Charles Kandl Jr., John Apgar, Roberta Cowley, and Josephine Hildabrant.

 

Also present were Mayor Steven Male, Borough Solicitor Peter Layman, Borough Manager Robin Zmoda and Borough Secretary Juli Lemak.   

Re-Appointments and Appointments:

                       

            Councilwoman Roberta Cowley made a motion and seconded by Councilman John Apgar to make the following re-appointments and appointment:

 

            Planning Commission – Jeffrey Fox, five (5) year term, expires 12/31/25

            Municipal Sewer Authority – Michael Zavacky, five (5) year term, expires 12/31/25

            Zoning Board – Troy Prutzman, five (5) year term, expires 12/31/25

Bureau of Fire Prevention - Dean Parsons, Carl Meixsell Jr., Grant Parsons, Brett Riker and Matthew Vantage - yearly appointment

            Disruptive Conduct Board of Appeals –Josephine Hildabrant – one (1) year term expires 12/31/2021

            Vacancy Board - John Cuono and Council - yearly appointment

            Sewage Enforcement Officer – Alex Ulmer, yearly appointment (employed by Borough Engineer Barry Isett and Associates). 

 

            Roll Call was taken of the motion and all Council Members voted in favor of the motion.

 

Appointment of Borough Representatives:  

 

            Councilwoman Roberta Cowley made a motion and seconded by Councilman John Apgar to make the following appointments:

 

            LVPC General Assembly – Janell Connolly, Delegate and Stephen Male, Alternate

            Northampton County Tax Collection Committee – Robin Zmoda, Delegate and Charles Kandl Jr., Alternate

            Multi-Municipal Comp Plan Steering Committee – Janell Connolly, Robin Zmoda and Jeffrey Fox

 

Roll call was taken of the motion and all Council Members voted in favor of the motion.

 

Councilwoman Janell Connolly made a motion and seconded by Councilman Scott Brumbaugh to make the following appointment: 

 

Slate Belt Regional Police Commission, Joseph LeDonne, Delegate and Stephen Male, Alternate.

           

Roll call was taken of the motion and all Council Members voted in favor of the motion.

 

Councilwoman Roberta Cowley made a motion, seconded by Councilwoman Tammy Kemp to nominate Mayor Stephen Male as Delegate for the COG.  Roll call was taken of the motion and all Council Members voted in favor of the motion.

 

Councilwoman Janell Connolly made a motion, seconded by Councilwoman Tammy Kemp to nominate Councilman Scott Brumbaugh as Alternate for the COG.  Roll call was taken of the motion and all Council Members voted in favor of the motion.

 

Open Records Officer:

            Councilman Scott Brumbaugh made a motion to appoint Borough Manager Zmoda as Open Records Officer and Borough Secretary Juli Lemak, alternate, seconded by Councilman Charles Kandl Jr.  Unanimous vote by roll call.

 

Liaison to Sewer Authority:

 

            Councilwoman Tammy Kemp made a motion to appoint Councilman Scott Brumbaugh as liaison to Sewer Authority, seconded by Councilwoman Josephine Hildabrant.  Unanimous vote by roll call.

 

Advertise for vacancies on Borough Boards:            

            Councilman Tammy Kemp made a motion to authorize Borough Manager Zmoda to advertise for vacancies on Borough Boards, seconded by Councilman Scott Brumbaugh.  Unanimous vote by roll call.

 

Setting of Council Meetings and Workshops for year 2021: 

            Councilwoman Tammy Kemp made a motion to hold Council Meetings on the 1st

Tuesday of every month at 7:00 P. M. and to hold Workshops on the last Tuesday of every month at 7:00 P. M., both Council Meetings and Workshops to be held via video and audio advanced communications using the Zoom internet application technology and telephone option and will not be held in person until further notice, seconded by Councilwoman Josephine Hildabrant.  Unanimous vote by roll call.


Resolution NO. 2021-01:       

            Borough Manager Zmoda presented Resolution NO. 2021-01 pertaining to fixing fees for applications and permits for the establishment, repair, alteration abandonment of on-lot septic

systems, pursuant to the provisions of Section 103.5 of the PA Sewage Facilities Act 35.  Councilwoman Janell Connolly made a motion to accept and approve Resolution NO. 2021-01 as presented, seconded by Councilwoman Tammy Kemp.  Unanimous vote by roll call.

 

Visitors:

 

Stephen Reider, Slate Belt Rising’s Director, announced the grant programs for 2021.

 

Adrianne Fors, representative of Waste Management, provided a landfill update.

             

Public Works:

 

            All Council Members were given a copy of Public Works Director Steven Bender's December report to review.   Bender was present.

 

Council received correspondence from Barry Isett & Associates about the Lobb Avenue project’s winterization and items to be completed. 

 

Zoning Report:

 

            All Council Members were given a copy of Zoning/Codes Office's December report and the property maintenance log.

 

            Borough Manager Zmoda notified Council she attended an affordable housing meeting with Zoning/Code Officer Charles Wolf and potential developers regarding Borough properties.

           

Police Report:

 

All Council Members were given a copy of the Slate Belt Regional Police minutes for their meeting of December 1, 2020 and December 17, 2020, December calls for service and the December 17, 2020 and January 5, 2021 agendas. 

           

Fire Chief's Report:

 

            Fire Chief Parsons reported the fire company received eight (8) calls for the month of December.  In 2020 the fire company responded to a total of 126 calls for the year. 

 

Fire Chief Parsons presented to Council the elected officers and positions for the 2021 calendar year.

 

Minutes:

 

            Councilwoman Tammy Kemp made a motion to approve the Minutes for the Council Meeting of December 10, 2020, seconded by Councilwoman Roberta Cowley.  Unanimous by roll call.

 

Correspondence:

 

Blue Mountain Community Library – Thank you for the donation.

 

Slate Belt Heritage Center – Thank you for the donation.

 

Councilwoman Robert Cowley – Letter of Resignation effective February 1, 2021.

 

Councilwoman Tammy Kemp made a motion to accept with regret the resignation of Councilwoman Roberta Cowley, effective February 1, 2021, seconded by Councilwoman Josephine Hildabrant.  Unanimous by roll call.

 

Councilman Charles Kandl, Jr. made a motion to advertise the Fourth (4th) Ward vacancy, seconded by Councilman Scott Brumbaugh.  Unanimous by roll call.

 

Barry Isett & Associates, Inc. – Thank you for the opportunity to be of service.

 

RCN – Fee increases for 2021. 

 

Mayor's Report:

 

            Mayor Male thanked Councilman Scott Brumbaugh and the Public Works Department for their assistance for with snow removal during the last snowstorm. 

 

Mayor Male also thanked Wase Management Representative, Adrianne Fors for her help with garbage removal from Lobb Avenue early in the morning before road work was completed for the season. 

 

Planning Commission:

 

            The next Planning Commission meeting is scheduled for January 21, 2021.


Solicitor:

 

Solicitor Layman advised Council Members they have thirty (30) days to fill the Fourth (4th) Ward vacancy at the March 2, 2021 meeting.  If the position remains vacant after the Council Meeting, the vacancy will go before the Vacancy Board.  Borough Manager Zmoda will advertise the vacancy on Facebook and the newsletter.

 

Solicitor Layman announced that his partner, David Jordan is retiring in the spring.  McFall, Layman and Jordan, PC will be dissolving.    He will be practicing under   Layman Law LLC at the same address.

 

Solicitor Layman informed Council the Penn Morris arbitration has been delayed because of the Covid-19 pandemic and has been rescheduled to early April.

 

Sanitation, Solid Waste & Recycling:

 

            All Council Members were given a copy of the Wastewater Treatment Plant December report.

 

Councilman Scott Brumbaugh made a motion to authorize the services for Maser Consulting’s proposal for the E. Babbitt Avenue and Moyer Avenue sewer extension project for $14,000.00, seconded by Councilman Charles Kandl Jr. Unanimous by roll call.

 

Council Members received a copy of a draft proposal letter from Maser Consulting to the Municipal Authority for a study to see if the sewer plant can handle the additional load from the proposed Winding Brook Development in Washington Township. 

 

A payment in the amount of $1,239.73 was received from NRG for participation in the demand response program. 

 

Finance, Tax Exoneration & Insurance:         

 

            All Council Members were given a copy of the December Treasury Report as prepared and submitted by Borough Manager/Treasurer Zmoda.  Councilman John Apgar made a motion to accept the Treasury Report as prepared, seconded by Councilman Charles Kandl Jr.  Unanimous by roll call.

 

            Councilman Charles Kandl, Jr. made a motion to grant Borough Secretary Juli Lemak permission to pay utility bills and other related bills between Council meetings, seconded by Councilman John Apgar.

 

Manager/Treasurer Zmoda informed Council there was a discussion with Wind Gap and Plainfield Township Manger’s regarding mandating the Covid-19 vaccine.  They currently will not mandate the employees to receive the vaccine. 

 

Property & Utilities:

 

Councilwoman Tammy Kemp made a motion to approve a proposal from Mister Kleen Window Cleaning, to clean the inside and outside of all the Borough office’s windows for $1,355.74, seconded by Councilman John Apgar.  Unanimous by roll call.

 

Councilman Charles Kandl Jr. made a motion to accept the proposal from George’s Plumbing for replacing the small heater in the Borough Office for $1,598.00, seconded by Councilwoman Tammy Kemp.  Unanimous by roll call.

 

Community Outreach:

 

            Borough Secretary Juli Lemak provided Council with the December feral cat report.

 

Borough Manager Zmoda informed Council Members the Revitalization Public Meeting has been put on hold due to the Covid-19 pandemic. 

 

Borough Manager's Report:

 

Council Members were given a copy of Borough Manager Zmoda’s December report.

 

Council Members received notification from the Department of Environmental Protection that the recycling grant award for $1,536.85 will be received in 4-6 weeks. 

 

Councilwoman Tammy Kemp made a motion to renew the 2021 membership with the Slate Belt Council of Governments for $1,400.00, seconded by Councilman Scott Brumbaugh.  Unanimous by roll call.

 

Payment of Bills:

 

The following bills were presented for payment:  General Fund, $18,893.85; Sewer Fund, $20,097.59; State Fund, $6,379.63 and Reserve Money Market Fund, $2,592.00.  Councilman Charles Kandl Jr. made a motion to pay the bills as presented, seconded by Councilman John Apgar.  The motion passed unanimous by roll call.

Councilwoman Roberta Cowley made a motion to adjourn, seconded by Councilman John Apgar.  Unanimous by voice vote.  Council meeting adjourned at 8:21 P.M.
