Tuesday 2nd of June 2020 - Council Meeting

Pen Argyl Borough Council held their Regular Council Meeting on Tuesday,

June 2, 2020 at 7:00 P. M. via Zoom Remote Meeting.

 

Pledge of Allegiance: 

                                               

            Council President Joseph LeDonne opened the Council Meeting with the Pledge of Allegiance at

7:00 P.M.

 

Roll Call:

 

The following Council Members were present and responded to roll call: Joseph LeDonne, Tammy Kemp, Janell Connolly, Charles Kandl Jr., John Apgar and Josephine Hildabrant.  Council Members Scott Brumbaugh and Roberta Cowley were absent.

Also present were Mayor Stephen Male, Borough Manager Robin Zmoda, Borough Solicitor Peter Layman and Administrative Assistant Juli Lemak.

 

Visitors:          

                       

            Tom Carlo, 306 S. Robinson Avenue, requested an additional one-way sign on the corner of Pen Argyl Street at the intersection of South Robinson Avenue.  He stated the existing sign is not close enough to the intersection and he has observed trucks turning onto Pen Argyl Street that turn around when they see the sign.  Borough Manager Zmoda stated the Public Works Department will investigate his concern. 

 

Public Works Report:             

 

            All Council Members were given a copy of Public Works Director Steven Bender's May report to review. 

 

            All Council Members were given a field observation report from Barry Isett & Associates Inc. for the Lobb Avenue reconstruction project. 

 

            Councilman Charles Kandl Jr. made a motion to open Weona Park to walkers, visitors must practice social distancing rules, wear masks and use at their own risk, provided the County is not in the red phase, seconded by Councilwoman Tammy Kemp.  The motion passed unanimous by roll call.   

 

Zoning Report: 

 

            All Council Members were given a copy of Zoning/Codes Office's May report.

 

            Borough Manager Zmoda attended a Zoom meeting with Councilwoman Janell Connolly and Slate Belt Rising’s Director Steven Reider to discuss the re-opening of businesses while the County is in the yellow phase of opening. 

 

 

Councilwoman Tammy Kemp made a motion to support the partial re-opening of businesses within the Borough by relaxing some of the zoning restrictions for retail businesses and restaurants, seconded by Councilman Charles Kandl Jr.  The motion passed unanimous by roll call.

 

Police Report: 

 

All Council Members were given a copy of the Slate Belt Regional Police Meeting minutes from May 5, 2020 and agenda from May 21, 2020. 

 

Council agreed to continue the suspension of enforcement of parking meters during the COVID-19 pandemic until the County goes into the green phase of opening.

 

Fire Chief's Report: 

 

            Fire Chief Parsons reported the fire company received three (3) calls for the month of May.  The total hours spent on drills was 110 and 50 hours on calls for a total of 160 man hours. 

                       

Minutes:

 

Councilwoman Tammy Kemp made a motion to approve the Minutes for the Council Meeting of Tuesday, May 5, 2020, seconded by Councilwoman Josephine Hildabrant.  The motion passed unanimous by roll call.

 

Council was given the Park Board agenda from May 12, 2020 and minutes of

March 10, 2020.

 

Council was also given the minutes from the Slate Belt Council of Governments from May 27, 2020.

 

Correspondence:       

 

            Council was given a thank you note from Councilwoman Tammy Kemp and Dean Kemp, thanking them for their generous donation to the American Forests in memory of Blane Smith. 

 

Council received a letter from Immaculate Conception School requesting the corners of W. Babbitt Avenue and N. Heller Avenue to be closed June 4th from 5:00 P.M. to 6:30 P.M. and

June 5th from 10:00 A.M. to 11:00 A.M. for a drive through graduation.  Councilwoman Tammy Kemp made a motion to accept the closure of the corners of W. Babbitt Avenue and N. Heller Avenue on June 4th from 5:00 P.M. to 6:30 P.M. and June 5th from 10:00 A.M. to 11:00 A.M.

 

 

Immaculate Conception School also sent notification they will not have their annual May Fair Celebration this year. 

 

Council received a letter from Lamont G. McClure, County Executive, announcing the County’s COVID-19 PPE Reopening Readiness Program.  The program will assist municipalities, non-profits and small businesses in their efforts to reopen by supplying a limited number of masks, wipes, hand sanitizers and gloves.

 

Council received correspondence from Pen Argyl High School announcing their contingency plan for diploma distribution if in person graduation cannot take place on June 18, 2020.

           

Mayor's Report:

 

            Mayor Stephen Male reported the Public Works Department picked up a donation of mulch from A. Scott Enterprises. 

           

Planning Commission:

 

            Nothing to report.

 

Solicitor's Report:

 

Ordinance Number 708 amending the Pen Argyl Park Ordinance to add the new section numbered 79-9 “Emergency Shutdown and Re-Opening” was presented.  Councilwoman Tammy Kemp made a motion to adopt Ordinance Number 708, seconded by Councilwoman Josephine Hildabrant.  The motion passed unanimous by roll call.

           

Sanitation, Solid Waste & Recycling:

 

All Council Members were given a copy of the Wastewater Treatment Plant’s May report. 

 

Council was given a quote to replace the interlocking contactor for pump #1 at the Main Street pumping station.  Councilman Charles Kadl Jr. made a motion to accept the quote from

M & S Service Co., Inc.  in the amount of $5,829.00, seconded by Councilman John Apgar.  The motion passed unanimous by roll call.

 

Council agreed to continue to waive interest and penalties on delinquent sewer billings until July 1, 2020.

 

 

Finance, Tax Exoneration, Insurance & Personnel:

 

All Council Members were given a copy of the May Treasury Report as prepared and submitted by Borough Manager/Treasurer Zmoda.  Councilwoman Josephine Hildabrant made a motion to accept the Treasury Report as prepared, seconded by Councilman Charles Kandl Jr. The motion passed unanimous by roll call.

 

            Council received notification of CD maturity from ESSA Bank & Trust.  Councilwoman Tammy Kemp made a motion to move the money on June 8, 2020, when the CD has matured, into the money market fund until a good rate is available, seconded by Councilman John Apgar.  The motion passed unanimous by roll call.

 

Property & Utilities:

 

            Council received Property Committee Meeting minutes from May 14, 2020 and

May 21, 2020. 

 

Community Outreach:

 

Borough Administrative Assistant Juli Lemak provided Council with the May feral cat report and update. 

 

Councilman Charles Kandl Jr. made a motion to add $5,000.00 to the refurbishing of the public works building project, replacing the personnel door trim and one overhead door, seconded by Councilman John Apgar.  The motion passed unanimous by roll call. 

 

Council discussed continuing to hold Council Meetings in Council Chambers or moving meetings downstairs social hall.  No action was taken.    

 

Councilwoman Josephine Hildabrant made a motion to postpone the Borough community wide yard sale from June 12th through June 14th to Friday, July 10th through Sunday, July 12th, seconded by Councilman Charles Kandl Jr.  The motion passed unanimous by roll call. 

 

Councilwoman Janell Connolly made a motion to publicly announce Council’s commitment to excellence and community policing to our residents and our business owners who may be people of any color that they may feel safe, protected and heard, pending approval of Council, seconded by Councilwoman Tammy Kemp.  The motion passed unanimous by roll call.

Page Five

 

 

Borough Manager Zmoda gave Council correspondence from the County of Northampton Division of Parks and Recreation regarding the 2019 Northampton County

Livable Landscapes Grant.  The Borough has until December 2021 to complete the Weona Park concession stand improvements. 

 

Council was given an e-mail notification from the Department of Community and Economic Development announcing the Borough will receive a grant in the amount of $64,999.00 for ADA access improvements to the municipal building. 

 

Payment of Bills:

           

            The following bills were presented for payment:  General Fund, $7,598.13; Sewer Fund, $70,863.26 and Reserve Money Market Fund, $14,023.10. Councilwoman Tammy Kemp made a motion to pay the bills as presented, seconded by Councilman Charles Kandl Jr.  The motion passed unanimous by voice vote.

 

Executive Session: 

 

            Councilman Charles Kandl Jr. made a motion to go into Executive Session to discuss real estate and personnel issues, seconded by Councilwoman Tammy Kemp.  The motion passed unanimous by voice vote

           

Council went into Executive Session at 8:37 P.M. and reconvened at 9:13 P.M.

 

Special Note:  Borough Administrative Assistant Juli Lemak left the meeting at 8:37 P.M. and the rest of the minutes were taken by Borough Manager Zmoda.   

 

Dolores Savitz Retirement:

 

Councilwoman Tammy Kemp made a motion to accept with regret the resignation letter from Secretary Dolores Savitz, seconded by Councilman John Apgar.  Unanimous by voice vote.

Lookout Fire Company No.1 Promissory Note:

Councilman John Apgar made a motion to accept the Modifications of Payments Due Under Promissory Note for Lookout Fire Company No. 1 as presented to Council by Solicitor Peter Layman, seconded by Councilman Charles Kandl Jr.  Unanimous by roll call vote.


 

Adjournment:

Councilwoman Tammy Kemp made a motion to adjourn, seconded by Councilwoman Josephine Hildabrant.  Unanimous by voice vote.  Council meeting adjourned at 9:21 P.M.
