Tuesday 1st of August 2017 - Borough Council Meeting

      

            Pen Argyl Borough Council held their Meeting for August on Tuesday, August 1, 2017 at 7:00 P. M. in the Fire Hall.

                                                                                               

Pledge of Allegiance:

            Council Vice President Dean Minnich opened the Council Meeting with the Pledge of Allegiance.                                                                                                                       

 

Roll Call:

            Council Members present and responding to roll call were:  Dean Minnich, Joseph LeDonne, Janell Connolly, Charles Kandl Jr., Roberta Cowley and Robert O'Donnell.  Council President Michael Nasatka was absent.

 

            Also present were Borough Solicitor Peter Layman, Borough Manager Robin Zmoda and Borough Secretary Dolores Savitz.

 

1st Ward vacancy:

            A letter of interest was received from Tammy Kemp, 704 Middletown Road, for the 1st Ward vacancy.  Vacancy was due to the resignation of Angelo Uliana.  Councilman Robert O'Donnell made a motion to appoint Tammy Kemp to the 1st Ward position.  Term of office is until the first Monday of January 2018.

 

            Notary Jan Williamson administered the oath of office to Tammy Kemp.  Kemp submitted the necessary Affidavit of Residency.

 

            Resolution NO. 2017-09 was submitted for approval to appoint a successor to serve on Borough Council filling a vacancy created by the resignation of 1st Ward Councilman Angelo Uliana.  Councilman Charles Kandl Jr. made a motion to accept and approve Resolution

NO. 2017-09 as presented, seconded by Councilman Joseph LeDonne.  Unanimous vote by roll call. 

 

Visitors:

            None.

 

Public Works Report:

            All Council Members were given a copy of Public Works Steven Bender's July report to review.  Bender was present. 

 

            A street light in Mary Mountain Estates has to be replaced at a cost of $2,670.00.  Councilwoman Roberta Cowley made a motion to replace the street light at a cost of $2,670.00 to be paid from the Reserve Fund, seconded by Councilman Joseph LeDonne.  Unanimous by roll call vote. 

 

        

            A report of findings and recommendations for the carousel building was received from Lee Golanoski, Barry Isett & Associates.  Borough Manager Zmoda will continue to try to get estimates to repair or replace part of the building as per the recommendations.

 

Zoning Report:                       

            All Council Members were given a copy of Zoning/Code Office's July report to review.

 

Police Report:            

            None was received.

 

Fire Chief Report:                  

            Fire Chief Dean Parsons reported that the fire company received seven (7) calls for July. 

They spent 143 hours on calls and 222 hours on drills. 

 

Minutes:         

            Councilman Robert O'Donnell made a motion to approve the Minutes for Regular Council Meeting of July 11, 2017, seconded by Councilwoman Roberta Cowley.  Unanimous by roll call vote. 

 

            Council was also given copies of minutes from Park Board Meeting of June 20, 2017 and NORCO COG Meeting of July 27, 2017. 

 

Correspondence:                    

            Pen Argyl Green Knight Football Team and Touchdown Club seeking support in the form of an advertisement which would be placed in their program.  Councilman Robert O'Donnell made a motion to take a full page ad for the amount of $75.00, seconded by Councilman Charles Kandl Jr.  Unanimous vote by roll call.

 

            Suburban EMS is offering a subscription and donation program to the Borough residents.  Their subscription is now underway for July 1, 2017 through June 30, 2018. 

 

Mayor's Report:

            Nothing to report.  Mayor Sabatine was not present.

 

Solicitor's Report:                  

            Borough Solicitor Layman requested an Executive Session before Council adjourned for possible litigation purposes.

 

 

Sanitation, Solid Waste & Recycling: 

            Council was given a copy of the Wastewater Treatment Plant's July report.

 

            Councilman Joseph LeDonne made a motion to authorize Borough Manager Zmoda to sent out RFP letters for a Wastewater Engineer and to have the Sewer Committee interview the engineers, seconded by Councilwoman Roberta Cowley.  Unanimous vote by roll call.

 

Finance, Tax Exoneration, Insurance & Personnel:   

            All Council Members were given a copy of the Treasury Report as prepared and submitted by Borough Manager/Treasurer Zmoda.  Councilman Charles Kandl Jr. made a motion to accept the Treasury Report as prepared, seconded by Councilwoman Roberta Cowley.  Unanimous by roll call vote.

 

            Council was also given a copy of the 2nd quarter budget comparison to review.

 

Property & Utilities:

            A quote was received from Bob Kauffman, 1114 Middletown Road, Pen Argyl, PA to remove existing basement door and replace with Gordon CO3 Unit for the amount of $850.00.  Painting and disposal to be done by Borough.  Kauffman will paint the sides of the door.  Councilman Joseph LeDonne made a motion to accept the proposal as submitted, seconded by Councilwoman Roberta Cowley.  Unanimous vote by roll call.

 

Community Outreach:           

            Borough Manager Zmoda informed Council that the Slate Belt Community Partnership funds have been closed out.  The Borough will get approximately $15,000 back.  Zmoda recommended that $10,000 be put towards the Slate Belt Rising Facade Program and perhaps the balance be put later towards signage in the Borough for businesses.  Councilman Charles Kandl Jr. made a motion to utilize the amount of $10,000 for the Slate Belt Rising Facade Program, seconded by Councilwoman Janell Connolly.  Unanimous vote by roll call.

 

Borough Manager's Report:              

            Borough Manager Zmoda presented Resolution NO. 2017-10 for approval which supports Senate Bill 745 providing local government entities with the option to use a statewide database for publication of its various actions and notices.  Councilman Robert O'Donnell made a motion to accept and approve Resolution NO. 2017-10 as presented, seconded by Councilman Charles Kandl Jr.  Council Members voting in favor of the motion were:  Dean Minnich, Tammy Kemp, Janell Connolly, Charles Kandl Jr., Roberta Cowley and Robert O'Donnell.  Councilman Joseph LeDonne voted no.  There being six (6) yes votes and one (1) no vote the motion carried.

 


            Councilman Joseph LeDonne made a motion to authorize Borough Manager Zmoda to send out letters to delinquent real estate tax payers giving them a chance to bring their taxes up to date prior to advertising their names in the newspaper, seconded by Councilwoman Roberta Cowley.  Council Members voting in favor of the motion were:  Dean Minnich, Tammy Kemp, Joseph LeDonne, Janell Connolly, Charles Kandl Jr. and Roberta Cowley.  Councilman Robert O'Donnell voted no.  There being six (6) yes votes and one (1) no vote the motion carried. 

 

Payment of Bills:        

            The following bills were presented for payment:  General Fund, $13,750.34; Sewer Fund, $50,887.08 and Reserve Money Market Fund, $130,946.76.  Councilman Robert O'Donnell made a motion to pay the bills as presented, seconded by Councilman Joseph LeDonne.  Unanimous vote by roll call. 

 

Executive Session:                  

            Councilwoman Roberta Cowley made a motion to go into Executive Session for personnel issues and possible litigation, seconded by Councilman Charles Kandl Jr.  Unanimous by roll call vote.  Council went into Executive Session at 8:02 P. M. and reconvened at 8:35 P. M.  Special Note:  Borough Secretary left at 8:03 P. M. and the rest of the minutes were taken by Borough Manager Zmoda.

 

Main Street Market Circular:                        

            Councilman Charles Kandl Jr. made a motion to authorize Borough Manager Robin Zmoda and resident Jeffrey Fox to meet with the Express Times Director of Distribution George Dyevoich concerning the Main Street Market Circulars, seconded by Councilwoman Roberta Cowley.  Unanimous by voice vote.

 

Adjournment: 

            Councilwoman Tammy Kemp made a motion to adjourn, seconded by Councilman Charles Kandl Jr.  Unanimous by voice vote.  Council Meeting adjourned at 8:36 P. M.
