Tuesday 11th of July 2017 - Borough Council Meeting


            Pen Argyl Borough Council held their Meeting for July on Tuesday, July 11, 2017 at

7:00 P. M. in the Fire Hall. 

 

Pledge of Allegiance:

            Council President Michael Nasatka opened the Council Meeting with the Pledge of Allegiance.

 

Roll Call:

            Council Members present and responding to roll call were: Michael Nasatka, Joseph LeDonne, Janell Connolly, Charles Kandl Jr., Roberta Cowley, Dean Minnich and Robert

O' Donnell.  Councilman Angelo Uliana was absent.

 

            Also present were Borough Solicitor Peter Layman, Borough Manager Robin Zmoda and Borough Secretary Dolores Savitz.

 

Visitors:

            Jeff Fox, 437 William Street, stated that he had reviewed the MS4 Permit, the Public Works Department cleans the street as well as some residents sweep in front of their property.  Fox felt that there was other ways to lower costs.

 

            Jeff Fox gave Borough Solicitor Layman a copy of the Mainstreet Market paper that the Express Times distributes throughout the Borough by tossing it onto the resident's property..  Layman acknowledged the receipt of the paper from Fox, he also stated that Borough Manager Robin Zmoda had given a copy to him as well.

 

            Fox also gave a complaint form to Borough Manager Zmoda objecting to the circulation of the paper. 

 

Public Works Report:

            All Council Members were given a copy of Public Works Steven Bender's June report to review.  Bender was present.

 

            Borough Manager Zmoda has sent a letter to PennDot requesting a traffic study for George Street SR1024 in order to prohibit trucks.  George Street is located in both Plainfield Township as well as Pen Argyl Borough.

 

            A Special Council Meeting has to be held on Tuesday, September 26th in order to hold a public meeting pertaining to the Rain Garden. 

 

            Resolution NO. 2017-08 was presented for approval.  The Borough is requesting a Community Investment Partnership Program (CIPP) grant of $50,00 from the Northampton County Department of Community & Economic Development (NCDCED) to be used for a salt shed and material storage area.  Councilman Charles Kandl Jr. made a motion to approve and  accept the Resolution as presented, seconded by Councilman Joseph LeDonne.  Unanimous vote by roll call.

 

Executive Session:

            Councilman Joseph LeDonne made a motion to go into Executive Session for possible litigation purposes, seconded by Councilman Charles Kandl Jr.  Unanimous by roll call vote.  Council went into Executive Session at 7:06 P. M. and reconvened at 7:38 P. M.

 

Zoning Report:

            All Council Members were given a copy of Zoning/Code Office's June report to review.

 

Police Report:

            Council Members were given copies of the SBRPD minutes for their meeting of June 6, 2017.  Also a copy of the June monthly report was given to Council Members.

 

Fire Chief Report:

            No one was present from the fire company.

 

Minutes:

            Councilwoman Roberta Cowley made a motion to approve the Minutes for Regular Council Meeting of Tuesday, June 13, 2017, seconded by Councilman Dean Minnich.  Unanimous by roll call vote.

 

            Councilman Joseph LeDonne made a motion to approve the Minutes for Special Council Meeting of Tuesday, June 27, 2017, seconded by Councilwoman Roberta Cowley.  Council Members voting in favor of the motion were:  Joseph LeDonne, Janell Connolly, Charles Kandl Jr., Roberta Cowley, Dean Minnich and Robert O'Donnell.  Council President Michael Nasatka voted abstained.  There being six (6) yes votes and one (1) abstained vote the motion carried. 

 

            Council was also given copies of minutes from Park Board Meeting of May 16, 2017 and COG Meeting of June 28, 2017.

 

Correspondence:

            Councilman Angelo Uliana submitted his resignation from Borough Council due to health reasons.  Resignation is effective Wednesday, July 12, 2017.  Councilman Dean Minnich made a motion to accept Angelo Uliana's resignation with regret, seconded by Councilman Joseph LeDonne.  Council Members voting in favor of the motion were:  Michael Nasatka, Joseph LeDonne, Janell Connolly, Charles Kandl Jr., Roberta Cowley and Dean Minnich.  Councilman Robert O'Donnell voted no.  There being six (6) yes votes and one (1) no vote the motion carried.

 

            A copy of a letter was received from Washington Township Zoning Officer, Robert Scott,

that was sent to Plainfield Township requesting that they be recognized and reserve the opportunity to comment and ask questions during the proceedings for the Synagro Technologies, Inc.'s biosolids facility site plan land use.

 

            A copy of a  letter was received from Waste Management that they had sent to the PA DEP that after further consideration they have decided to withdraw the Minor Permit Modification for Solidification Plan Modifications that was submitted on March 28, 2016. 

 

            Waste Management has submitted a NPDES Renewal Application to the PA DEP for the Stephens Jackson Quarry location in the Borough.

 

Mayor's Report:

            Nothing to report.  Mayor Sabatine was not present.

 

Planning Commission:

            Nothing to report.

 

Solicitor's Report:

            Nothing to report.

 

Sanitation, Solid Waste & Recycling:

            Council was given a copy of the Wastewater Treatment Plant's June report.

 

            Councilman Charles Kandl Jr. made a motion to begin RFP process for a wastewater engineer, seconded by Councilman Joseph LeDonne.  Unanimous vote.

 

            Borough Manager Zmoda informed Council that polymer that is purchased from Pollu-Tech, Inc. doesn't have to be bid due to that they are already under a co-star contract.  The co-star contract amount will be reflected in future bills.

 

Finance, Tax Exoneration, Insurance & Personnel:

            All Council Members were given a copy of the Treasury Report as prepared and submitted by Borough Manager/Treasurer Zmoda.  Councilman Dean Minnich made a motion to accept the Treasury Report as prepared, seconded by Councilwoman Roberta Cowley.  Unanimous vote by roll call.

 

            Borough Solicitor Layman sent a letter to the Borough Municipal Authority that he has reviewed issuance of the Sewer Revenue Bonds Series A of 2016 and they are in compliance with the Borough's provisions.

 

            The audit reports on the 2016 Borough funds have been received from Palmer & Company.  Councilman Dean Minnich made a motion to accept the audit report as received from Palmer & Company, seconded by Councilman Robert O'Donnell.  Unanimous vote by roll call. 

 

            Councilman Charles Kandl Jr. made a motion to approve Councilwoman Janell Connolly to be a signer on Borough banking, seconded by Councilman Joseph LeDonne.  Unanimous by roll call vote. 

 

Property & Utilities:   

            The first draft of the office renovations has been received and Borough Manager Zmoda will review the draft with the engineer. 

 

Community Outreach:

            A copy of the Slate Belt Rising Regional Cooperation Meeting's agenda for June 15, 2017 was given to all Council Members.

 

Borough Manager's Report:  

            Borough Manager Zmoda informed Council that an employee meeting was held on June 14th.  Administrative Assistant  Julianne Lemak has been put in charge of the Safety Committee.

 

            The Newsletter has been sent out with the survey for the Weona Park Master Site Development Plan.

 

Payment of Bills:        

            The following bills were presented for payment:  General Fund, $196,369.39; Sewer Fund, $55,414.53; State Fund, $3,848.72 and Reserve Money Market Fund, $137,918.06.  Councilman Robert O'Donnell made a motion to pay the bills as presented, seconded by Councilman Dean Minnich.  Unanimous vote by roll call.

 


Executive Session:

            Councilman Dean Minnich made a motion to go into Executive Session for contract negotiations and possible litigation, seconded by Councilman Charles Kandl Jr.  Unanimous

by roll call vote.  Council went into Executive Session at 8:02 P. M. and reconvened at 8:28 P. M.

Special Note:  Borough Secretary Savitz left at 8:03 P. M. and the rest of the minutes were taken by Borough Manager Zmoda.

 

Rescind Resolution #2017-06:

            Councilman Joseph LeDonne made a motion to rescind Resolution #2017-06 regarding the transfer of ownership for the 1985 International to the Lookout Fire Company, seconded by Councilwoman Janell Connolly.  Unanimous  by voice vote.

 

Promissory Note with Lookout Fire Company:          

            Councilman Joseph LeDonne made a motion to approve the Promissory Note with Lookout Fire Company prepared by Solicitor Peter Layman with zero percent (0%) interest for ten (10) years subject to the Borough retaining the ownership of the 1985 International utility truck, seconded by Councilman Robert O'Donnell.  Unanimous by voice vote.

 

"Mainstreet Market" handbills:

            Councilman Charles Kandl Jr. made a motion to authorize Solicitor Peter Layman to write a letter to the Express Times regarding their "Mainstreet Market" handbills requiring them to either get a permit and deliver them as per the Borough's ordinance or cease and desist the practice of throwing them onto private property in the Borough, seconded by Councilman Roberta Cowley.  Unanimous by voice vote.

 

Parking in Weona Park's lot:

            Council President Michael Nasatka stated that more and more tractor trailers are once again parking in Weona Park's lot behind the Turkey Hill and he wants them removed and to not allow them to park there.

 

Adjournment:

            Councilman Dean Minnich made a motion to adjourn, seconded by Councilman Joseph LeDonne.  Unanimous by voice vote.  Council Meeting adjourned at 8:35 P. M.
