Wednesday 30th of November 2016 - Special Council Meeting

            Pen Argyl Borough Council held a Special Council Meeting on Tuesday, November 29, 2016 at 7:00 P. M. in the Fire Hall for the purpose of adopting a Tentative 2017 Budget and for General Purposes.

 

Pledge of Allegiance:

            Council President Michael Nasatka opened the Council Meeting with the Pledge of Allegiance.                                                                                                                          

 

Roll Call:         

            Council Members present and responding to roll call were:  Michael Nasatka, Angelo Uliana, Joseph LeDonne, Charles Kandl Jr., Roberta Cowley, Dean Minnich and Robert O'Donnell.  Councilman Jan Surotchak was absent.

 

            Also present were Borough Solicitor Peter Layman, Borough Manager Robin Zmoda and Borough Secretary Dolores Savitz.

 

Visitors:

            Jeffrey Fox, 437 William Street, was present as an observer.

 

Discussion and Tentative Adoption of Year 2017 Budget:

            The Tentative 2017 Budget was presented to Council as follows:

 

                            General Fund - $1,723,445.00 - 11.00 Mills (Increase of 0.75 Mills)

                               Sewer Fund - $1,896,008.00

                            Garbage Fund - $449,200.00

                                State Fund - $180,996.00

                           Reserve Fund - $3,386,150.00

 

                                        Tax Structure

                        Real Estate Tax Millage - 11.00 Mills

                                             Per Capita - $ 5.00

                        Local Services Tax (LST) - $52.00

           Real Estate Transfer Tax - 1% - Shared Equally with School District

                    Earned Income Tax - 1% - Shared Equally with School District

                      Sewer Rental Fee - $96.00 Minimum Quarterly Charge per Unit/10,000 Gallons

                                                          $13.50 per Thousand Gallon over 10,000 Gallons      

                             Garbage Fee - Garbage Fee Waived for year 2017

 

            The Borough's Assessment Valuation for 2017 is $67,572,400, 2016's Assessment

was $67,524,800.  One (1) Mill equals $67,572.00, less 7% uncollectible, collectible amount

is $62,842.00.

 

            Prior years Millage was 9.75 Mills from year 2011 to and including year 2015.  Year 2016 Millage was 10.25, was an increase of 0.5 Mills.

 

            Council reviewed and discussed the Tentative 2017 Budget as presented.

 

            Councilman Dean Minnich made a motion to adopt the Tentative Year 2017 with the 0.75 Mill increase, seconded by Councilman Angelo Uliana.  Unanimous vote by roll call.

 

            Councilman Dean Minnich made a motion to adopt the Tax Structure for year 2017, seconded by Councilman Angelo Uliana.  Unanimous by roll call vote. 

 

Millage Ordinance and also to suspend Residential Garbage Charges:

            Councilman Charles Kandl Jr. made a motion to authorize Borough Solicitor Layman to prepare and advertise the necessary ordinances for the 11.00 Tax Millage and also to suspend residential garbage charges under Section 60-4D for the calendar year of 2017 for adoption at the Council Meeting of Thursday, December 15, 2016, seconded by Councilman Dean Minnich.  Unanimous by roll call vote.  Garbage Contract with Waste Management ended March 31, 2016 with extension provisions.

 

Buy back of two (2) weeks unused vacation:

            Councilwoman Roberta Cowley made a motion to buy back two (2) unused weeks vacation for management employees, seconded by Councilman Dean Minnich.  Unanimous vote by roll call.

 

Minutes:                     

            Councilman Dean Minnich made a motion to approve the Minutes for the Council Meeting of Tuesday, November 1, 2016, seconded by Councilman Charles Kandl Jr.  Unanimous by roll call vote.

 

Weona Park Master Site Plan:

            Council identified the four (4) following consultants to interview on Wednesday, December 7th:  (1) Urban Research & Development Corporation, 28 W. Broad Street, Bethlehem, PA 18018; (2) YSM, 19 S. Newberry Street, York, PA 1740l; (3) Environmental Planning and Design, LLC, 100 Ross Street, Suite 500, Pittsburgh, PA 15219 and (4) Stromberg/ Garrigan and Associates, Inc., 50 Mallard Road, Holland, PA 18066.

Executive Session:

            Councilman Dean Minnich made a motion to go into Executive Session to discuss personnel and potential litigation issues as requested by Borough Manager Zmoda and Borough Solicitor Layman, seconded by Councilman Joseph LeDonne.  Unanimous vote by roll call.  Council went into Executive Session at 8:17 P. M. and reconvened at 8:27 P. M.  Special Note:  Borough Secretary Savitz left at 8:18 P. M. and the rest of the minutes were taken by Borough Manager Zmoda.

 

Teamster's Agreement:

            Councilman Dean Minnich made a motion to accept the January 1, 2017 through December 31, 2019 Teamster's contract as presented, seconded by Councilwoman Roberta Cowley.  Unanimous by voice vote.

 

Quality of Life Ordinance:

            Council President Michael Nasatka asked if a review of Quality of Life Ordinance could

be presented during this meeting so it could potentially be advertised for adoption at the December 15, 2016 meeting.  Solicitor Layman presented an ordinance and a review of the ordinance for Council.  This ordinance is based on a Jim Thorpe Ordinance and will need to be modified to agree with the Pen Argyl Borough Code.  Suggested changes are to drop the appeals language and move to magistrate, pass a resolution to determine who would be responsible for citations and set fines.  Councilman Charles Kandl Jr. made a motion to modify the presented Ordinance with the modifications and advertise for adoption at the December 15, 2016 meeting, seconded by Councilwoman Roberta Cowley.  Unanimous by voice vote.

            Councilwoman Robert Cowley made a motion to adjourn, seconded by Councilman Angelo Uliana.            Unanimous by voice vote.  Council Meeting adjourned at 8:39 P. M.
