Pen Argyl Borough Council held their June Council Meeting on Tuesday, June 7,
2016 at 7:00 P. M. in the Fire Hall.
Pledge of Allegiance:
Council President Michael Nasatka opened the Council Meeting with the Pledge of Allegiance.
The following Council Members were present and responded to roll call: Michael Nasatka, Angelo Uliana, Joseph LeDonne, Charles Kandl Jr., Roberta Cowley and Robert O'Donnell. Councilmen Jan Surotchak and Dean Minnich were absent.
Also present were Mayor Mikal Sabatine, Solicitor Peter Layman, Borough Manager Robin Zmoda and Borough Secretary Dolores Savitz.
Public Works Report:
All Council Members were given a copy of Public Works May report. Public Works Director Steven Bender was present.
An estimate was received from JMT Environmental Technologies, P. O. Box 22044, Lehigh Valley, PA for soil characterization, transportation and disposal services of the existing heating oil soil pile at the park. Estimate submitted was as follows: (1) Soil pile characterization $850.00; (2) Soil transportation & disposal $98.00 per ton and (3) Soil transportation (under 23 tons per load) $35.00 per ton. Councilman Angelo Uliana made a motion to accept and award the estimate to JMT Environmental Technologies as submitted, seconded by Councilman Charles Kandl Jr. Unanimous vote by roll call.
A quote was received from MAX-R for twenty five (25) picnic tables, which included three (3) picnic tables that are handicap accessible, for total amount of $23,816.00. MAX-R is
a vendor with Co-Stars. Councilman Joseph LeDonne made a motion to accept the quote as presented and to purchase the twenty five (25) picnic tables from MAX-R for the amount of $23,816.00 which is to be paid from the Borough Reserve Fund, seconded by Councilman Robert O'Donnell. Unanimous by roll call vote.
A copy of the park pavilion schedule was given to all the Council Members to review.
All Council Members were given a copy of Zoning/Codes Office's May report.
Copies of the Minutes for the Slate Belt Regional Police Commission meeting of April 5th and the April incident report were given to all Council Members.
Mayor Sabatine reported that the May Minutes were approved at tonight's meeting. The carnival dates and parade route have also been approved.
Sergeant Jonathon Hoadley and Officer Joseph Torre received commendations tonight for their life saving actions when they were dispatched for a report of an overdose. They administered Naloxone and the individual became responsive.
Mayor Sabatine further reported that the Summer Sounds will begin on Sunday, June 12th starting at Wind Gap Park.
Fire Chief's Report:
Fire Chief Dean Parsons reported that the fire company responded to five (5) calls for the month of May. Total man hours on calls was 186 and hours on drills was 215.
Councilman Angelo Uliana made a motion to approve the Minutes for Council Meeting of May 5, 2016, seconded by Councilwoman Roberta Cowley. Unanimous vote by roll call.
Copies of minutes for SBCOG Meeting 05/25/16 were given to Council.
Invitation from SBCOG for an informational seminar on Multi Municipal Comprehensive Planning & Economic Development on Wednesday, June 22nd at 7:00 P. M. to be held at the Bee Hive in Bangor.
Mayor Sabatine had nothing further to report.

Borough Solicitor Borough Layman had nothing to report.
Sanitation, Solid Waste & Recycling:
All Council Members were given a copy of the Wastewater Treatment Plant May
Council was also given copies of the engineer report from 06/06/16, Authority Minutes from their meeting of 05/04/16. Authority July Meeting will be held on Monday, July 11th.
The Authority discussed the refinancing of the bonds. It would shorten the bank loan by two (2) years, interest rate of 2% and savings over $100,000. The Authority recommended to start proceeding with the refinancing. Councilman Robert O'Donnell made a motion to agree to move forward with the Authority's recommendation, seconded by Councilman Charles Kandl Jr. Unanimous vote by roll call.
Borough Manager Zmoda informed Council that there was a sewer issue at 751 Pen Argyl Street which is in Plainfield Township. A repair has to be done to the sanitary line which will cost the authority $9,900. Councilman Angelo Uliana made a motion to approve the repair, seconded by Councilwoman Roberta Cowley. Unanimous by roll call vote.
Councilman Robert O'Donnell made a motion to release the amount of $229,932.00 from the Sewer Fund to the authority as in this year's budget, seconded by Councilman Angelo Uliana. Unanimous by roll call vote.
Finance, Tax Exoneration & Insurance:
All Council Members were given a copy of the Treasury Report as prepared and submitted by Borough Manager/Treasurer Zmoda. Councilman Charles Kandl Jr. made a motion to accept the Treasury Report as prepared, seconded by Councilman Joseph LeDonne. Unanimous vote by roll call.
Councilman Angelo Uliana made a motion to deposit the annuity pay out for $169,524.67 from CM Life Insurance Company, Policy Number ODY 1534 1269, into the Reserve Fund, seconded by Councilman Robert O'Donnell. Unanimous by roll call vote.
Councilwoman Roberta Cowley made a motion to accept the Borough 2015 audit report from Palmer & Company, seconded by Councilman Joseph LeDonne. Unanimous by roll call vote.
A copy of the 1st quarter budget comparison as prepared by Borough Manager/
Borough Treasurer Zmoda was given to all Council Members.
Property & Utilities:
Nothing to report.
Borough Manager Zmoda gave Council Members a copy of Twelve Ways to Improve Your Neighborhood. A copy of these simple steps will be included in the June newsletter which will be mailed to the Borough residents.
Zmoda also gave a copy of the Farm Mobile Market information schedule to all Council Members which will be at the Slate Belt YMCA for the first time on Tuesday, June 14th from 4:00 P. M. to 6:00 P. M.
Borough Manager's Report:
Councilman Angelo Uliana made a motion to participate in the Lehigh Valley Hazard Mitigation Plan Update project as per information submitted by Borough Manager Zmoda, seconded by Councilman Charles Kandl Jr. Unanimous vote by roll call.
Borough Manager Zmoda presented Resolution No. 2016-04 for Pen Argyl Borough to participate in the Slate Belt Council of Government's Animal Control Program. Councilwoman Roberta Cowley made a motion to accept and approve Resolution No. 2016-04 as presented, seconded by Councilman Joseph LeDonne. Unanimous by roll call vote.
Payment of Bills:
The following bills were presented for payment: General Fund, $27,421.48; Sewer Fund, $57,107.50; State Fund, $3,320.89 and Reserve Money Market Fund, $8,129.70. Councilman Joseph LeDonne made a motion to pay the bills as presented, seconded by Councilman Angelo Uliana. Unanimous by roll call vote.
Councilman Charles Kandl Jr. made a motion to go into Executive Session to discuss personnel and possible litigation issues, seconded by Councilwoman Roberta Cowley. Unanimous vote by roll call. Council went into Executive Session at 7:26 P. M. and reconvened at 8:35 P. M. Special Note: Borough Secretary Savitz left the meeting at 7:27 P. M. and the rest of the minutes were taken by Borough Manager Zmoda.
Councilman Charles Kandl Jr. made a motion to terminate Penn Morris Corporation as the pavilion project's contractor under contract sections 5.61(c) and 5.61 (d), seconded by Councilman Angelo Uliana. Unanimous by voice vote.
Councilman Joseph LeDonne made a motion to withhold any payments due to Penn Morris Corporation for the pavilion project under contract sections 5.61 and 7.3 until the project is complete; due to possible filing of claims against Penn Morris Corporation for prevailing wage violations and possible failure to make payments to subcontractors, seconded by Councilman Charles Kandl Jr. Unanimous by voice vote.
Councilman Robert O'Donnell made a motion to adjourn, seconded by Councilwoman
Roberta Cowley. Unanimous by voice vote. Council adjourned at 8:38 P. M.
